ZONING ADMINISTRATOR AND GRANTINGA VARIANCE ON
VARIANCE APPLICATION 66-67 FILED BY DISABLED
AMERICAN VETERANS THRIFT STORES, SUBJECT TO CONDITIONS
WHEREAS, after hearing on notice, the Zoning Administrator
DENIED a variance on Variance Application No. 66-67, filed by
DISABLED AMERICAN VETERANS THRIFT STORES, and Appeal Application
No. 180 was duly filed by the applicant, presenting the matter to
the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that said variance application meets the requirements
of Section 9250.8 of the Santa Ana Municipal Code; that the decision
of the Zoning Administrator should be overruled; and that said
variance should be granted, subject to certain applicable conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby overrule the decision of the Zoning
Administrator and does hereby grant a variance on Variance Application
No. 66-67 to permit an outdoor retail sales area at 420 East Fifth
Street, Santa Ana, California, in a C-2 District. Said Variance is
granted subject to the following conditions:
That the owner remove all existing sidewalk and construct a solid
sidewalk on Fifth Street and Mortimer Street, and that all
drives be closed except one 20~foot drive on Mortimer Street
as shown on the plot plan; and
2. That a 6-foot masonry wall or a substitute acceptable to the
Planning Department be constructed around the sales area.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its adjourned regular meeting h~d~n the 25th dg~ of October,
1966.
