HomeMy WebLinkAbout66-157R~SOLUTION 66-157 OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REGARDING THE DUTIES AND RESPONSIBILITIES OF THE CITY MANAGER WITH REFERENCE TO ARTICLE V, SECTION 501, OF THE CHARTER OF THE CITY OF SANTA ANA WHEREAS, Section 501 of Article V of the Charter of the City of Santa Ana sets forth the duties and responsibilities of the City Manager as the Chief Administrative Officer and head of the administra- tive branch of the City government; and WHEREAS, the said Section 501 of Article V of the Charter of the City of Santa Ana provides that the City Manager shall be responsible to and under the direction of the City Council for the proper administration of all affairs of the City; and WHEREAS, included within the general powers and obligations of the City Manager are the following, as provided in Section 501 of Article V of the City Charter: (a) Subject to the civil service provisions of this Charter, appoint and remove all department heads and officers of the City except those officers the power of appointment of who~ is vested in the City Council and as otherwise provided in this Charter, and pass upon and approve all proposed appointments and removals of subordinate employees, by all officers and heads of offices, agencies, and departments; (b) Prepare the budget annually and submit it to the City Council and be responsible for its administration after adoption; (c) Prepare and submit to the City Council as of the end of the fiscal year a complete report on the finances and ad- ministrative activities of the City for the preceding year; (d) Keep the City Council advised of the financial condition and future needs of the City and make such recommendations as to these matters as may see~ to him desirable; (e) Keep himself informed of the activities of the several agencies, offices, and departments of the City and see to the proper administration of their affairs and the efficient conduct of their business; (f) Be vigilant and active in causing all provisions of the law to be executed and enforced; (g) Perform all such duties as may be prescribed by this Charter Or required of him by the City Council, not inconsistent with this Charter; (h) Submit a monthly report to the City Council covering significant activities of the City agencies, offices, and departments under his supervision and any significant changes in administrative rules and procedures promulgated by him; (i) Submit special reports in writing to the City Council in answer to any requests for information filed with him by a member of the City Council; and WHEREAS, the City Council, in keeping with its proper function, and bearing in mind the powers and obligations of the City Manager as hereinabove described, wishes hereby to express its serious concern upon the question of the operation of the Police Department of the City of Santa Aha, and upon certain inharmonious and disruptive elements within said police department; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby expresses its conviction that the City Manager has within his authority, responsibility, and capabilities the means to undertake the solution of whatever problems exist within the Police Department of the City of Santa Aha; BE IT FURTHER RESOLVED: That the City Council hereby directs the City Manager to develop a plan of action designed to solve these personnel problems, to implement this plan upon formulation, and to report his progress to the City Council upon request. BE IT FURTHER RESOLVED: That the City Manager has the support of the City Council in his efforts to correct whatever problems exist within the Police Department, or any other department of the City under his jurisdiction and control, and to maintain all such departments of the City of Santa Ana in a condition of smooth and efficient operation.
