PLANNING COMMISSION AND GRANTING A VARIANCE ON
APPLICATION NO. 66-95 FILED BY JOSAM INVESTMENT
COMPANY, SUBJECT TO APPLICABLE CONDITIONS
WHEREAS, after hearing on notice, the Planning Cormnission
DENIED a ~ariance on Variance Application No. 66-95, filed by
JOSAM INVESTMENT COMPANY and Appeal Application No. 186 was duly
filed by said applicant presenting the matter to the City Council;
and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the requirements
of Section 9250.8 of the Santa Aha Municipal Code; that the decision
of the Planning Commission should be overruled; and that the said
Variance should be granted subject to applicable conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana does hereby overrule the decision of the
Planning Commission and does hereby grant a variance on Variance
Application No. 66-95 to permit the construction of a 140-unit
apartment complex that encroaches into required street side yard
and rear yard with less than the required parking area at the north-
east corner of Harbor Boulevard and Kent Avenue, Santa Ana, Cali-
fornia. Said Variance is granted subject to the following applicable
conditions:
1. That development be according to the approved plot plan, except
for minor modifications approved by the Planning Department.
That a full landscape plan be submitted to and approved by the
Planning Department. All landscaping approved shall be planted
and maintained. Planting shall be implemented prior to a
utility release.
3. That all requirements of the R 3 District be complied with.
4. That all parking lot lighting be shielded away from residences
to the east.
THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE
ISSUANCE OF A BUILDING PERMIT:
That an easement be provided for Harbor Boulevard for a width
of 60 feet, centerline to property line, for street purposes
and vehicular access rights except at street intersections and
approved drives.
NOTE: Access can be determined and approved prior to dedication.
NOTE:
Dedication shall be initiated by owner, through the Depart-
ment of Public Works, at least two weeks prior to applica-
tion for a building permit to avoid delay.
6. That the owner submit street improvement plans for Harbor
Boulevard.
7. That all elevations be on 1958 Orange County Survey Datum.
That all plans and surveys for the required improvements be
completed by the owner's engineer and submitted to the Depart-
ment of Public Works for approval.
THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE
ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING
SAFETY AND HOUSING:

That the Owner provide sanitary sewer and storm drain facilities
to meet with the approval of the Department of Public Works.
That the owner place curb, gutter and full width sidewalk and
pave up to the edge of existing pavement on Harbor Boulevard.
The new curb and gutter to be placed 50 feet east of the center
of Harbor Boulevard.
That the owner comply with all conditions set by Council for
Preliminary Record of Survey 413.
