AN EASEME~ FOR STREET PURPOSES AT THE NORTH-
WEST CORNER OF SEVENTEENTH AND SANTIAGO STREETS
WHEREAS, in order to provide for a more orderly flow of
traffic on Seventeenth Street in the City of Santa Aha it has
become necessary to widen and improve said street from Broadway
east to Santiago Street;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana does hereby find and declare that the public
interest and necessity require that Seventeenth Street be widened
and improved from Broadway east to Santiago Street to provide for
a more orderly flow of east-west traffic, and further require that
said City do have, take, and acquire for street purposes that
certain real property in the City of Santa Ana, County of Orange,
State of California, described as:
PARCEL 1: An Easement for street purposes over the
Northerly 10.00 feet of the Southerly 50.00 feet of
that portion of the Dericot Tract in the Glassell
and Chapman Allotment of the Rancho Santiago de Santa
Aha in Section 6, Township 5 South, Range 9 West,
described as follows:
Beginning at the intersection of the centerline of
East Seventeenth Street, 60 feet wide, with the
centerline of Santiago Avenue (formerly "C" Street,
60 feet wide); thence Northerly along the centerline
of Santiago Avenue, 140 feet; thence Westerly parallel
with the North line of said Seventeenth Street, 371
feet; thence South, parallel with the centerline of
Santiago Avenue, 140 feet to the centerline of said
Seventeenth Street, 60 feet wide, thence Easterly
along the centerline of said Seventeenth Street, 371
feet to the point of beginning.
Excepting therefrom the Westerly 180.00 feet; also
excepting therefrom the Easterly 30.00 feet.
PARCEL 2: An Easement for street purposes over that
portion of the Dericot Tract in the Glassell and
Chapman Allotment of the Rancho de Santa Aha in
Section 6, Township 5 South, Range 9 West, described
as follows:
A spandrel shaped parcel of land bounded Easterly by
the Northerly prolongation of the Easterly line of
Parcel 1 above; bounded Southerly by the Northerly
line of Parcel 1 above; and bounded Northwesterly by
the arc of a curve concave Northwesterly having a
radius of 25.00 feet and being tangent to said East
and South Boundaries.
BE IT FURTItER RESOLVED:
1. That the City Attorney is hereby ordered to bring an
action in the name of the City of Santa Ana to condemn said prop-
erty necessary to be taken and to do all things necessary to prose-
cute said action to final determination;
2. That the public interest, necessity, and convenience
require, and it is hereby ordered, that said city take immediate
possession and use of the property herein ordered to be acquired
upon compliance with the requirements of law applicable thereto
as a right of way for public use;
3. That said public improvement is planned and located in
a manner which will be most compatible with the greatest public
good and the least private injury.
4. That the City of Santa Aha, a municipal corporation, is
authorized and empowered to provide for the opening, extension,
widening, construction and maintenance of public streets and high-
ways within the City; and
5. That said action in condemnation shall be taken in
accordance with the provisions of the Code of Civil Procedure and
the Constitution of the State of California relating to eminent
domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the iTth day of April, 1967.
