HomeMy WebLinkAbout67-079RESOLUTION 67-79 AUTHORIZING CONDEMNATION OF A FIVE-ACRE PARCEL OF REAL PROPERTY SOUTH OF SANTA CLARA AVENUE, WEST OF PORTOLAPAP~K, FOR THE EXTENSION OF PORTOLA PAR/~ W~EREAS, the rapid population growth in the northeasterly portion of the City of Santa Aha makes it necessary that additional space be provided for recreational activities by the extension of Portola Park; and WHEREAS, there is land lying without the City Limits that is conveniently adjacent to the existing Portola Park, NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that public interest and necessity require the acquisition of land west of Portola Park as permitted by Sections 5301 and 5302 of the Public Resources Code of the State of California for the extension and enlargement of said Park, and further require that the City do have, take, and acquire, in fee, that certain land in the County of Orange, State of California, described as: The real property in the Rancho Santiago de Santa Ana, County of Orange, State of California, described as: Commencing at a point twenty-five (25) rods East of the North- west corner of the "J. W. Davenport Tract" in the "A. B. Chapman Tract", as surveyed by Frank Lecouvrer in December, 1870, and running thence South 32 rods; thence East 25 rods; thence North 32 rods and thence West 25 rods to the place of beginning, containing five (5) acres, more or less, RESERVING THEREFROM a strip 25 feet wide along the North line for road purposes. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the City of Santa Ana is authorized and empowered to acquire, develop, maintain, and operate public parks within and without the City; 3. That the public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That said action in condemnation shall be taken in accord- ance with the provisions of the Code of Civil Procedure, the Public Resources Code, and the Constitution of the State of California relating to eminent domain.
