HomeMy WebLinkAbout67-023RESOLUTION 67-23 ACCEPTING A DEED FROM ALLSTATE INSURANCE COMPANY WITH NO CASH CONSIDERATION BUT SUBJECT TO CERTAIN CONDITIONS WHEREAS, ALLSTATE INSURANCE COMPANY, an Illinois corporation, has executed a deed dated January 12, 1967, conveying to the City of Santa Aha easements for street purposes on the south side of Fourth Street and the east side of the Santa Ana Freeway; and WHEREAS, said deed is granted with no cash consideration, but subject to certain conditions to be c~plied with prior to the recording of said deed; NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana accepts said deed from ALLSTATE INSURANCE COMPANY and approves the following conditions as consideration for said conveyance: The City will at its sole expense do all work necessary to repair and/or replace any damaged Allstate property as re- quired to return it to its original condition which shall include, but not necessarily be limited to the following specific items: Reconstruct the four driveway entrances to Allstate Insurance Company's ("Allstate") property and repair or replace any curbs, lawns, shrubbery, trees or other improvements damaged or destroyed by the pro- posed widening of Fourth Street. Included will be the complete construction of new entrance at east side of property with all associated curb, fence, paving, tree and planting removal. The new drive- way shall be essentially as shown on sketch received with your letter of December 27, 1966 complete with necessary painting of pavement arrows and lines. Area of removal of existing driveway shall be left in suitable condition for planting ivy by owner. Install a new full width concrete sidewalk along entire frontage of Allstate's property. Sidewalk to be full width from curb to property lines. Trees will be planted at approximately 50 foot spacings in sidewalk area. Relocate light fixtures adjacent to Allstate's front entrances to a place satisfactory to Allstate to clear new street construction. Allstate will endeavor as far as possible to clear all new street construction with their new irriga- tion system and landscaping. The City will repair and replace all lawn, shrubbery, sprinkler heads or any other improvements damaged by the construction. 5. Provide left turn lane for west bound traffic into Atlstate's westerly most entrance to their property. which conditions must be complied with prior to the recording of this deed. BE IT FURTHER RESOLVED: That Carl J. Thornton, the City's designated agent, is directed to place his certificate of Acceptance on said deed.
