OF A QUITCLkIM DEED TO PACIFIC SOUTHWESTEP~N
PROPERTIES UPON A CONTINGENCY
WHERE~S, heretofore, Pacific Southwestern Properties has
expressed a desire to purchase certain real property owned by the
City of Santa Ana0 said real property located on the south side of
Eighth Street and the east side of Bristol Street; and
WHEREAS, Pacific Southwestern Properties also is desirous of
purchasing real property belonging to the City of Santa Ana located
on the south side of Eighth Street, west of Baker Street; and
WHEREkS, both items of real property which Pacific Southwestern
Properties has indicated a desire to purchase have been declared
to be surplus properties and have been offered for sale; and
WHEREAS, Pacific Southwestern Properties have tendered to the
City of Santa Ana the high bid for the purchasg of property designated
AP 8-011-45, said offer contingent, however, upon their acquiring the
remaining surplus property designated as AP 8-011-6, 7, 8, and 36; and
WHEREAS, it is agreeable to the City of Santa Ana that the
purchase of AP 8-011-45 be made contingent on Pacific Southwestern
Properties acquisition of the remaining surplus City property herein-
before referred to.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk
of the Council are hereby authorized and directed to execute a deed
quitclaiming the interest of the City of Santa Ana, a municipal
corporation, in and to the following described real property:
Ail that certain real property situated in the
City of Santa Ana, County of Orange, State of California,
described as follows:
That portion of Lot 2 of "Montgomery Tract", also
known as "Tract No. 33", as shown on a map thereof, recorded
in book 9, page 31, Miscellaneous Maps, records of said
Orange County, described as Commencing at the intersection
of the South line of Hickey Street (now known as Eighth
Street) with the East line of Bristol Street, as said
Bristol Street existed in 1917, running thence South
along the East line of Bristol Street, 120 feet; thence
East parallel to the South line of Hickey Street, 50.00
feet; thence North parallel to the East line of Bristol
Street, 120 feet to the South line of Hickey Street; thence
West 50.00 feet to the POINT OF BEGINNING.
EXCEPTING THEREFROM THE North 30.00 feet and the
West 30.00 feet.
ALSO EXCEPTING THEREFROM that portion lying North-
westerly of a curve concave Southeasterly having a radius
of 25.00 feet and tangent to the West and North lines
above described.
and to deposit said deed in Escrow No. 10-1020-A at Trans-State Title
Company with instructions, however, that said deed shall be effective
only in the event the grantee thereon described is the successful
bidder on that parcel of real property described in the supplement
to the Escrow instructions in Escrow No. 10-1020-A, said supplement
dated June 13, 1967; and upon the further contingency that grantee
in said deed is successful in acquiring the easement across the real
property described in the Escrow amendment of June 13, 1967.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 3rd day of July, 1967.
