PLANNING COMMISSION AND GRANTING A VARIANCE ON
VARIANCE APPLICATION NO. 67-48 FILED BY JOHN C.
JOHNSON, SUBJECT TO APPLICABLE CONDITIONS
WHEREAS, after hearing on notice, the Planning Commission
DENIED a variance on Variance Application No. 67-48 filed by JOHN
C. JOHNSON, and Appeal Application No. 19'2 was duly filed by said
applicant presenting the matter to the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the requirements
of Section 9250.8 of the Santa Ana Municipal Code; that the decision
of the Planning Commission should be overruled; and that said
Variance should be granted subject to applicable conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana does hereby overrule the decision of the
Planning Commission and does hereby grant a variance on Variance
Application No. 67-48 to permit the construction of a duplex dwelling
at 1303 South Broadway, Santa Ana, California, in an R-1 District;
said Variance is granted subject to the following applicable
conditions:
That development be according to the approved plot plan except
for minor modifications approved by the Planning Department
and except for the north side yard which shall be increased
to a minimum of four (4) feet.
NOTE:
The "X" dimension of a drive may encroach into
adjacent property only with the written consent of
adjacent property owner.
