DEED TO GILBERT K. RANNEY ET AL WITH NO CASH
CONSIDERATION
WHEREAS, by Judgment in Condemnation the City of Santa Aha
has acquired fee title in and to certain land on the west side of
Harbor Boulevard, south of First Street, for drainage purposes,
and in said Judgment in Condemnation GILBERT Ko RANNEY, as Executor
of the Estate of KENNETH W. RANNEY, deceased, and HUMPHRIES INVEST-
MENTS, INCORPORATED, were granted an easement over and across said
property;
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk
of the Council are hereby authorized and directed to execute a deed
granting to GILBERT K. RANNEY, as Executor of the Estate of KENNETH
W. RANNEY, deceased, and HUMPHRIES INVESTMENTS, INCORPORATED, the
following described easement:
An easement over, across, and above the following described property
in the City of Santa Ana, County of Orange, State of California:
The southerly 35.00 feet of the east half of the northeast quarter
of the northeast quarter of Section 16, Township 5 South, Range
10 West, in the Rancho Las Bolsas, as shown on a map recorded in
Book 51, Page 12, of Miscellaneous Maps, Records of Orange County,
California.
EXCEPTING THEREFROM the easterly 50.00 feet;
together with the right to cover said channel at their own expense,
provided said covering be accomplished upon a permit duly issued
by the City of Santa Aha, and provided further that said covering
be accomplished to the specifications of the City of Santa Ana.
This easement and the rights attached thereto as described herein
may be leased, subleased, assigned or conveyed without restriction
by the grantees therein, provided, however, that said easement
shall remain and said covering may be maintained so long as a
possessory interest in and to the land immediately adjacent thereto
and presently leased to GILBERT K. RANNEY, as Executor of the Estate
of KEA/NETH W. RANNEY, deceased, and HUMPHRIES INVESTMENTS, INCOR-
PORATED, are held by the same person(s) or entity.
No structure of any kind may be erected upon said easement. Its
use shall be restricted to provide parking space or access roads
or driveways along or across said easement,
and deliver the same to said grantee.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 18th day of September, 1967.
