HomeMy WebLinkAbout67-196RESOLUTION 67-196 MODIFYING SIDEWALK REQUIREMENTS IMPOSED BY THE ZONING ADMINISTRATOR IN GRANTING A VARIANCE ON APPLICATION NO. 67-81 FILED BY VOIT RUBBER CORPORATION WHEREAS, after public hearing on notice the Zoning Adminis- trator granted a Variance on Application No. 67-81, filed by VOIT RUBBER CORPORATION, to permit off street parking with less than the required number of spaces in an M-1 District at 3801 South Harbor Boulevard, Santa Ana, California; said Variance was granted subject to certain applicable conditions; and WHEREAS, Appeal Application No. 197 was duly filed by the applicant appealing the requirement that a full width sidewalk be placed on Harbor Boulevard and Sunflower Avenue which was imposed by the Zoning Administrator in his approval of said Variance 67-81; and Wq~EREAS, after public hearing on notice, the City Council has determined that Condition No. 7 of the Findings of Fact of the Zoning Administrator should be modified to read as hereinbelow set out. NOW, THEREFORE, BE IT RESOLVED: That the finds made and the conditions imposed by the Zoning Administrator are approved except that Condition No. 7 of the Findings of Fact on said Variance shall read as hereinbelow set out; said Variance is granted subject to the following conditions: That the development otherwise be according to the approved plot plan except for minor modifications approved by the Planning Department; 2. That a detailed landscape plan for the area around the proposed building be submitted to and approved by the Planning Department; That in the event the total number of employees using the off- street parking facilities is greater than the number of available parking spaces, then the applicant shall provide additional off-street parking facilities in direct proportion to the demand. 4. That the use of the premises be limited to W. J. Voit Rubber Corporation. THE FOLLOWING CONDITION IS TO BE COMPLIES WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: o That a deed be provided for access rights to Sunflower Avenue at the location where the existing drive is closed. The City will quitclaim access rights on Sunflower Avenue at the location of the proposed new drive. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: That the owner provide sanitary sewer facilities and pay the remaining District 7 sewer charges ($1,120.80 to be paid). That the owner construct full width sidewalks for the entire length of their property along Harbor Boulevard and Sunflower Avenue at such time as adjacent property is developed or at the end of five years, whichever is sooner. -1- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 20th day of November, 1967.
