THE ZONING ADMINISTRATORAND GRANTING A VARIANCE
ON APPLICATION NO. 67-95 FILED BY GEORGE L. TANEY
SUBJECT TO APPLICABLE COATDITIONS
WHEREAS, after hearing on notice, the Zoning Administrator
denied a variance on Variance Application No. 67-95 filed by
GEORGE L. TANEY, and Appeal Application No. 199 was duly filed by
the applicant presenting the matter to the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the requirements
of Section 9250.8 of the Santa Ana Municipal Code; that the decision
of the Zoning Administrator should be overruled; and that said
Variance should be granted subject to applicable conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby overrule the decision of the Zoning
Administrator and does hereby grant a variance on Application No. 67-95
to permit the construction of a building at 410 West First Street in
the City of Santa Ana for automobile repair use on property zoned
c-1. Said Variance is granted subject to the following applicable
conditions:
THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE
OF A BUILDING PERMIT:
That easements be provided for north-south alley and for east-west
alley for a width of 10 feet, center line to property line, for
street purposes and for vehicular access rights to First Street,
except at alley. The above easements to include alley corner
cut-offs. (No access allowed from First Street.)
NOTE:
Dedication shall be initiated by owner, through the
Department of Public Works, at least two weeks prior
to application for a Building Permit to avoid delay.
2. That the subdivider submit street improvement plans for north-
south alley and east-west alley.
3. That all elevations be on 1958 Orange County Survey Datum.
4. That all plans and surveys for the required improvements be
completed by the owner's engineer and submitted to the Depart-
ment of Public Works for approval.
THE FOLLOWING CONDITIONS A~E TO BE COMPLIED WITH PRIOR TO ISSUANCE
OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING:
1. That the owner provide sanitary sewer facilities to meet with the
approval of the Department of Public Works.
2. That the owner place alley improvements for full width of existing
right of way with gutter on future center line of alley.
3. That the owner pay a sewer assessment reimbursement of $3.00 per
front foot for First Street.
4. That the owner construct a block or solid masonry wall not less
than 6 feet high on the west property line between the alley
and the building.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 20th day of November, 1967.
