PROPERTIES BETWEEN THE CITY AND kLFRED J.
GUTIERREZ AND FRIEDA GUTIERREZ ON THE NORTH
SIDE OF FIRST STREET, EAST SIDE OF HESPERIAN,
WITH CASH CONSIDERkTION DUE TO THE GRANTEE
WHEREAS, ALFRED J. GUTIERREZ and FRIEDA GUTIERREZ, also known
as Edpidia F. Gutierrez, have executed a deed dated November 1, 1967,
conveying to the City of Santa Ana an easement for street purposes
on the north side of First Street, and the east side of Hesperian,
with a cash consideration of $17,347.00 in exchange for which ~e City
will convey to said ALFRED J. GUTIERREZ and FRIEDA GUTIERREZ other real
property which has been declared surplus on the north side of First
Street, east of Hesperian, which property has a cash value of
$8,815.00, the sale of which was authorized by the City Council of
the City of Santa Ana on October 19, 1967; and
WHEREAS, the CITY OF SANTA kNA, has agreed to pay to
Alfred J. Gutierrez and Frieda Gutierrez the difference in equity of
the interest in real property being exchanged hereby in the amount
of $8,532.00; and
WHEREAS, said transaction is to be handled through Escrow
Number 55318-C with Security Title Insurance Company, Santa Ana,
California.
NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
accepts said deed from Alfred J. Gutierrez and Frieda Gutierrez
granting to the City the following described property:
Ail that certain land situated in the State of California, County
of Orange, City of Santa Ana, described as follows:
PARCEL 1: Thel South 40.00 feet of Lots 10 and 11 and the
South 40.00 feet of the West 27 feet of Lot 12 in Block D
of Goldsmith's Addition to Santa Ana, in the City of Santa
Ana, as shown on a map recorded in Book 31, page 23 of
Miscellaneous Records of Los Angeles County, California.
PARCEL 2: A spandrel shaped parcel of land in Lot 10,
Block D of Goldsmith's Addition to Santa Ana, in the City of
Santa Ana, as shown on a map recorded in Book 31, page 23,
of Miscellaneous Records of Los Angeles County, California
bounded Southerly by the North line of Parcel 1; bounded
Westerly by the West line of said Lot 10; bounded Northeasterly
by the arc of a curve concave Northeasterly, having a radius
of 25 feet, and tangent to the West line of Lot 10 and the
North line of Parcel 1 above described.
Grantors also grant to the City of Santa Ana, a temporary
easement over the East 16 feet of Lot 11 and the West 27
feet of Lot 12, Block D of said Goldsmith's Addition to
Santa Ana, for the purpose of demolishing the building
situated thereon. Said easement to terminate February 1,
1968 or upon demolition of the building as disclosed by the
recordation of a notice of completion, whichever first occurs.
and Carl J. Thornton, the City's designated agent, is directed to
place his Certificate of Acceptance on said deed:
BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
Council are hereby authorized and directed to execute a deed for and
on behalf of the City of Santa Ana granting to Alfred J. Gutierrez
and Frieda Gutierrez that certain real property in the City of Santa
Ana, County of Orange, State of California, described as:
Lot 12 and the West 18 feet of Lot 13 in Block D of Goldsmith's
Addition to the Town of Santa Ana, in the City of Santa Ana,
as shown on a map recorded in book 31, page 23 of Miscellaneous
Records of Los Angeles County, California.
EXCEPT the West 27 feet of Lot 12.
ALSO EXCEPT the South 40.00 feet of Lots 12 and 13.
and deliver the same into Escrow No. 55318-C.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 4th day of December, 1967.
