HomeMy WebLinkAbout68-056RESOLUTION 68-56 APPROVING MkP, DECLARING INTENTION TO VACATE EXCESS RIGHT OF WAY ON DEEREAVE~J3E AT THE kTCHISON, TOPEKA, AND SANTA FE RAILWAY RIGHT OF WAY, AND GIVING NOTICE OF HEARING THEREON W~EREAS, as a result of the realignment of Deere Avenue excess right of way has been created and the Department of Public Works has requested that said excess right of way be declared unnecessary for present or prospective street purposes and that the same be vacated and abandoned; and the Planning Commission has recommended that a public hearing be set on the question of said vacation; NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of said right of way proposed to be vacated. The City Council declares its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate that certain excess right of way on Deere Avenue at the Atchison, Topeka, and Santa Fe Railway right of way; said right of way proposed to be vacated lies in the City of Santa Ana, County of Orange, State of California, and is described as: That portion of Lot 115 in Block 9 of Irvine's Subdivision, in the County of Orange, State of California, as per map recorded in Book 1, Page 88, of Miscellaneous Records Maps, in the office of the County Recorder of said County, described as follows: Beginning at the intersection of a line that is parallel with and distant Southwesterly 60.00 feet, measured at right angles, from the Northeasterly line of said Lot 115 with the Northwesterly line of said Lot 115; thence Southeasterly along said parallel line 170.59 feet to the beginning of a tangent curve, concave North- easterly having a radius of 280.00 feet; thence Northwesterly along the arc of said curve through a central angle of 19° 51' 30" an arc distance of 97.05 feet to a point of reverse curvature with a tangent curve concave Southwesterly having a radius of 220.00 feet; thence Northwesterly along the arc of said curve through a central angle of 19° 51' 30" an arc distance of 76.25 feet to a point distant Northeasterly, 30.00 feet, measured at right angles, from the point of beginning; thence Southwesterly along the North- westerly line of said Lot 115, 30.00 feet to the point of be- ginning. BE IT FURTHER RESOLVED: That May 6, 1968, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation. BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said street, stating the passage of this Resolution of Intention to vacate and the time and the place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of hearing.
