HomeMy WebLinkAbout68-114RESOLUTION 68-114 INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "FAIRHAVEN AVENUE AND LINCOLN AVENUE NORTHEAST ANNEX" AND GIVING NOTICE OF PROTEST HEARING THEREON WHEREAS, on July 10, 1968, the Local Agency Formation Commission of Orange County approved the map and description of territory proposed to be annexed to the City of Santa Aha, California; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory to the City of Santa Ana for the following reasons: That said territory can best be served by the City of Santa Aha with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained anywhere else in the County of Orange; and e That it is landowners City; to the mutual advantage of the City and the that said territory become a part of said BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of Government Code Section 35303 on the date of the adoption of this Resolution; and that said territory is contiguous to the City of Santa Ana, lies in the County of Orange, State of California, and is described as: Commencing at the intersection of the center lines of Fairhaven Avenue and Glassell Street, said intersection being the south- west corner of Lot 13 in Block "D" of the A. B. Chapman Tract as laid out and surveyed by Frank Lecouvreur in 1870, as shown on a map recorded in Book 102, Page 15 of Miscellaneous Maps, Records of Orange County, California, and running thence South 89° 56' 00" West 84.50 feet, along the center line of Fairhaven Avenue, to the northwest corner of the land described as parcel one in deed to Johan Jacob Mueller, recorded July 24, 1897 in Book 31, Page 61 of Deeds, Records of Los Angeles County, California, and to the true point of beginning; thence South 00° 04' 00" East along the West line of said land of Johan Jacob Mueller, and along the City boundary of Santa Aha as annexed by Resolution 66-11, a distance of 30.00 feet to the northwest corner of the land annexed to the City of Santa Ana by the Fairhaven and Glassell S. E. Annex, by Ordinance NS-735; thence South along the West boundary of the City of Santa Aha as annexed by Ordinance NS-735, a distance of 250.00 feet; thence South along the City boundary as annexed by Ordinance NS-921 a distance of 384.28 feet to an angle point in said City boundary and to the South line of that certain seven acre parcel conveyed to W. W. Martin by deed recorded May 21, 1894 in Book 69 at Page 298 of Deeds, Records of Los Angeles County, California; thence West along said South line and along said City boundary as annexed by Ordinance NS-921 a distance of 737.96 feet to an angle point in said City boundary and to the East boundary of the City of Santa Ana as annexed by the Lincoln and Virginia W. Annex, Ordinance NS-469; thence Northerly along said City boundary as annexed by Ordinance NS-469, and along a line that is parallel with and 25 feet Easterly, measured at right angles, from the center line of Lincoln Avenue, a distance of 169.66 feet; thence North 0" 05' 40" East along the City boundary as annexed by Ordinance NS-526 a distance of 523.28 feet to an angle point in said City boundary; thence North 89" 50' 10" West along said City boundary as annexed by Ordinance NS-526 a distance of 41.82 feet -1- to an angle point in said City boundary, and to the Westerly right of way line of the Atchison, Topeka and Santa Fe Railroad, 100 feet in width, as shown on a map filed in Book 33, Page 47, Record of Surveys of Orange County; thence Northwesterly along the arc of a curve, concave Westerly, having a radius of 1382.69 feet through a central angle of 19° 53' 43", an arc distance of 480.12 feet, and along said City boundary as annexed by Ordinance NS-526, and along said right of way line of the Atchison, Topeka and Santa Fe Rail- road to a point on a tangent line; thence North 24" 14' 00" West along said tangent line, and along said City boundary as annexed by Ordinance NS-526, a distance of 103.72 feet to an angle point in said City boundary; thence North 75° 41' 47" East along the City boundary as annexed by Ordinance NS-241, a distance of 101.52 feet, more or less, to an angle point in said City boundary and to the Easterly line of said Atchison, Topeka and Santa Fe Rail- road; thence North 24° 14' 00" West along said City boundary as annexed by Ordinance NS-241, and along said Easterly line of the railway a distance of 246.31 feet to the Southerly corner of Annexation 42 as annexed to the City of Orange by Ordinance 583; thence departing from said Santa Aha City boundary, North 38° 52' 08" East along the Southeasterly line of said Annexation 42 to the City of Orange, and along the Northeasterly extension of the Southeasterly line of that certain parcel of land described as Parcel 1 in Book 800, Page 154 of Official Records of Orange County, a distance of 240.70 feet to the Southerly line of that certain parcel of land conveyed to the State of California by deed recorded November 29, 1965 in Book 7753, Page 744, Official Records of said Orange County; thence departing from said City boundary of Orange, South 59° 43' 30" East 457.89 feet; thence South 57° 31' 54" East 326.86 feet; thence South 78° 33' 08" East 114.54 feet; thence South 41° 00' 53" East 66.57 feet; thence North 78° 36' 33" East 57.94 feet to.the center line of Glassell Street and to a point on a boundary of the City of Santa Aha as annexed by Resolution 66-11, said point being 569.34 feet Northerly, measured at right angles, from the center line of Fairhaven Avenue; thence South 1° 00' 08" West along said center line of Glassell Street, and along said City boundary of the City of Santa Ana as annexed by Resolution 66-11, a distance of 302.34 feet to an angle point in the City boundary of the City of Santa Ana as annexed by Resolution 68-21; thence North 88° 59' 38" West along said City boundary as annexed by Resolution 68-21, a distance of 285.00 feet to an angle point in said City boundary; thence South 1° 00' 08" West along said City boundary of the City of Santa Ana as annexed by Resolution 68-21, a distance of 267.00 feet to an angle point in said City boundary and to the center line of Fairhaven Avenue; thence South 88° 59' 38" East along said City boundary of the City of Santa Ana as annexed by Resolution 68-21, a distance of 200.50 feet to the true point of beginning. BE IT FURTHER RESOLVED: That "FAIRHAVEN AVENUE AND LINCOLN AVENUE NORTHEAST ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that September 3, 1968, at the hour of 7:30 P.M. in the Council Chambers, city Hall, Third and Main Streets, Santa Aha, California, is the time and place fixed at which said Council will hear written protests against this annexation made by any person owning property within said territory. At any time prior to the final adjournment of the hearing on protest against this annexation, any owner of property within the territory may file written protest against this annexation. The protest shall state the name of the owner of the property affected and the street address or other description of the property sufficient to identify it on the last equalized assessment roll, all as provided for in california Government Code Section 35312. -2- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 15th day of July, 1968.
