HomeMy WebLinkAbout69-009RESOLUTION 69-9 AUTHORIZING CONDEMNATION OF REAL PROPERTY NECESSARY FOR THE LOCATION OF A FIRE STATION WITHIN THE CITY OF SANTA ANA WHEREAS, because of the rapid population growth in the City of Santa Ana it is necessary that a new fire station be located to adequately protect the structures within the City of Santa Ana from fire hazard; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require the construction of a new fire station and the acquisition of a land site therefor; that fee title be acquired for this fire station site; and further require that said City do have and acquire that certain real property in the city of Santa Ana, County of Orange, State of California, described as: That portion of Block "A" of the A. B. Chapman Tract surveyed by Frank Lecouvreur in 1870, as shown on a map recorded in Book 102, Page 15 of Miscellaneous Maps, Records of Orange County California, described as follows: Beginning at the intersection of the center line of Grand Avenue, with a line that is parallel with and 140.00 feet Northerly, measured at right angles, from the center line of Santa Clara Avenue; thence Easterly along said last mentioned parallel line 180.00 feet; thence Southerly, at right angles, 140.00 feet to the said center line of Santa Clara Avenue; thence Westerly along said center line to said center line of Grand Avenue; thence Northerly along said center line of Grand Avenue to the point of beginning. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 3. That the City of Santa Ana is authorized, empowered, and required to provide fire protection for structures within the City and in the furtherance thereof to maintain fire stations to house equipment and men necessary for said function; 4. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
