HomeMy WebLinkAbout69-010RESOLUTION 69-10 APPROVING MAP AND DECLARING INTENTION TO VACATE STREETS IN THE CIVIC CENTER A~EA BETWEEN FLOWER AND ROSS STREETS NORTH OF FOURTH STREET, RESERVING EASEMENTS THEREIN FOR PUBLIC UTILITIES, AND GIVING NOTICE OF HEARING THEREON W}{EREAS, the Director of Public Works and the Planning Commission have recommended abandonment proceedings of the public rights of way located within the Civic Center area and described herein and have recommended that a public hearing be set on the matter of said abandonment; NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of said rights of way proposed to be vacated. The City Council declares its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate those certain portions of Sixth Street, Fifth Street, Fourth Street, Garnsey Street, Parton Street, and VanNess Avenue lying between Flower and Ross Streets, North of Fourth Street, and RESERVING THEREIN an easement for water main purposes and easements for utility structures for the Pacific Telephone Company. Said rights of way proposed to be vacated lie in the City of Santa Aha, County of Orange, State of California, and are described as follows: SIXTH STREET, GARNSEY STREET TO ROSS STREET: That portion of Sixth Street as shown in the Ross Addition to Santa Aha, City of Santa Ana, as shown on a map thereof recorded in Book 3, Pages 534 and 535, Miscellaneous Records of Los Angeles County, California, bounded Westerly by the West line of Garnsey Street as shown in said Ross Addition to Santa Ana, and bounded Easterly by a line parallel and 53.00 feet Westerly, measured at right angles, from the center line of Ross Street as shown in said Ross Addition to Santa Ana. RESERVING an easement for potable water main purposes over a strip of land 15.00 feet in width, the center line of which is 17.50 feet Northerly from the center line of said Sixth Street. ALSO PdESERVING an easement and right of way, 20.00 feet in width, the center line of which is 20.00 feet Southerly from the center line of said Sixth Street, to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone, telegraph and communication structures as the Pacific Telephone Company may, from time to time, require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances. FIFTH STREETt FLOWER STREET TO ROSS STBRRT: That portion of Fifth Street as shown in the Ross Addition to Santa Ana, City of Santa Ana, as shown on a map thereof recorded in Book 3, Pages 534 and 535, Miscellaneous Records of Los Angeles County, California, bounded Westerly by a line parallel and 53.00 feet Easterly, measured at right angles, from the center line of Flower Street, formerly Orange Street as shown on said Ross Addition to Santa Ana, and bounded Easterly by a line that is con- centric or parallel and 54.00 feet Northerly and Westerly, measured at right angles, from the following described center line: -1- Beginning at a point on the center line of Fourth Street, 80.00 feet wide, distant 100.00 feet Westerly from the center line of Parton Street, 60.00 feet wide, as said streets are shown in said Ross Addition to Santa Aha, said point being the beginning of a tangent curve concave Northwesterly having a radius of 800.00 feet; thence Northeasterly along the arc of said curve through a central angle of 40° 53' 43" an arc distance of 570.01 feet to a tangent line; thence North 48° 45' 33" East along said tangent line a distance of 248.70 feet to the center line of Ross Street. RESERVING an easement and right of way, 15.00 feet in width, the center line of which is 22.50 feet Northerly from the center line of said Fifth Street, to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone, telegraph and communication structures as the Pacific Telephone Company may, from time to time, require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances. FOURTH STREET~ VAN NESS AVENUE TO ROSS STREET: That portion of Fourth Street as shown in the Ross Addition to Santa Ana, City of Santa Ana, as shown on a map thereof recorded in Book 3, Pages 534 and 535, Miscellaneous Records of Los Angeles County, California, bounded Northerly by the North line of said Fourth Street; bounded Southerly by a line parallel and 16.00 feet Northerly, measured at right angles, from the center line of said Fourth Street; bounded Easterly by the arc of a curve concave Northwesterly, having a radius of 25.00 feet, and being tangent to said Southerly boundary and to a line parallel and 40.00 feet Westerly, measured at right angles, from the center line of Ross Street as shown in said Ross Addition to Santa Ana; bounded North- westerly by a line that is concentric or parallel and 54.00 feet Southerly and Easterly, measured at right angles, from the follow- ing described center line: Beginning at a point on the center line of Fourth Street, 80.00 feet wide, distant 100.00 feet Westerly from the center line of Parton Street, 60.00 feet wide, as said streets are shown in said Ross Addition to Santa Ana, said point being the beginning of a tangent curve concave Northwesterly having a radius of 800.00 feet; thence Northeasterly along the arc of said curve through a central angle of 40° 53' 43" an arc distance of 570.01 feet to a tangent line; thence North 48° 45' 33" East along said tangent line a distance of 248.70 feet to the center line of Ross Street. Said portion of Fourth Street being bounded Westerly by the arc of a curve concave Easterly, having a radius of 5.00 feet, and being tangent to said Southerly boundary and to said Northwesterly boundazl&! RESERVING an easement and right of way, 15.00 feet in width, the center line of which is 32.50 feet Northerly from the center line of said Fourth Street, to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone, telegraph and communication structures as the Pacific Telephone Company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances. Said 15.00 foot strip to be terminated on the East by the Easterly boundary above described and terminated on the West by a line that is distant 82.00 feet Westerly from the Southerly prolongation of the East line of Block A of said Ross Addition to Santa Ana. -2- GARNSEY STP~EET, FOURTH STREET TO SIXTH STREET: That portion of Garnsey Street as shown in the Ross Addition to Santa Ana, City of Santa Aha, as shown on a map thereof recorded in Book 3, Pages 534 and 535, Miscellaneous Records of Los Angeles County~ California, bounded Northerly by the North line of Sixth Street as shown in said Ross Addition to Santa Ana and bounded Southerly by a line parallel and 54.00 feet Northerly, measured at right angles, from the center line of Fourth Street as shown in said Ross Addition to Santa Ana. RESERVING an easement and right of way, 10.00 feet in width, the center line of which is 25.00 feet Westerly from the center line of said Garnsey Street, to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone, telegraph and communication structures as the Pacific Telephone Company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances. Said 10.00 foot strip to be terminated on the North by the South line of Sixth Street, as shown in said Ross Addition to Santa Ana and terminated on the South by the North line of Fifth Street as shown in said Ross Addition to Santa Ana. VAN NESS AVENUE~ FOURTH STREET TO SIXTH STREET: That portion of Van Ness Avenue, formerly Lowe Street, as shown in the Ross Addition to Santa Ana, City of Santa Ana, as shown on a map thereof recorded in Book 3, Pages 534 and 535, Miscellaneous Records of Los Angeles County, California, bounded Northerly by the North line of Sixth Street as shown in said Ross Addition to Santa Ana, and bounded Southerly by a line parallel and 40.00 feet -3- Northerly, measured at right angles, from the center line of Fourth Street as shown in said Ross Addition to Santa Ana. EXCEPTING THEREFROM a strip of land, 108.00 feet wide, the center line of which is described as follows: Beginning at a point on the center line of Fourth Street, 80.00 feet wide, distant 100.00 feet Westerly from the center line of Parton Street, 60.00 feet wide, as said streets are shown in said Ross Addition to Santa Ana, said point being the beginning of a tangent curve concave Northwesterly having a radius of 800.00 feet; thence Northeasterly along the arc of said curve through a central angle of 40° 53' 43" an arc distance of 570.01 feet to a tangent line; thence North 48° 45' 33" East along said tangent line a distance of 248.70 feet to the center line of Ross Street. BE IT FURTHER RESOLVED: That February 17, 1969, at the hour of 7:30 P.M. in the Council Chambers, city Hall, Third and Main Streets, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation. BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said streets, stating the passage of this ~Resolution of Intention to vacate and the time and the place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted on each street being vacated. Both publication and posting shall be completed at least ten (10) days before the date of hearing.
