ALBERT F. AND LOUISE SCHROEDER FOR WHICH
THE CITY IS PAYING A CASH CONSIDERATION OF
$7,175 AND ACCEPTING A_N OFFER OF DEDICATION
FROM SAID GRANTORS
WHEREAS, ALBERT F. SCHROEDER and LOUISE SCHROEDER have executed
a deed dated January 15, 1969, conveying to the City of Santa Ana a
parcel of real property for street widening on the south side of
Memory Lane at Baker Street, and all vehicular access rights to Memory
Lane at said location, except the Easterly 17.00 feet, for which the
City is paying a cash consideration of $7,175.00; said transaction to
be handled through Escrow No. 56052-C with Security Title Insurance
Company, Santa Ana, California; and
WHEREAS, ALBERT F. SCHROEDER and LOUISE SCHROEDER have executed
an Offer of Dedication dated January 15, 1969, by which document they
offer to dedicate to the City of Santa Ana vehicular access rights over
the Easterly 17.00 feet to Memory Lane; and
WHEREAS, this Offer of Dedication is without a cash consideration
being paid to said grantors and shall become effective upon the occurrence
of one of the following contingencies:
1. The death of the survivor of the offerors.
2. Redevelopment of the subject property by subdivision
or relocation of structures.
3. The sale (other than by subdivision) of any portion
of said land.
4. Any event which would enable access to the subject
property to be from Baker Street.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor is hereby
authorized to sign the Escrow instructions; that the City of Santa Ana
accepts said deed and offer of dedication, and Carl J. Thornton, the
City's designated agent, is directed to place his Certificate of
Acceptance on said instruments.
PASSED AND ADOPTED by the City Council of the City of Santa
its regular meeting held on the 20th day of January, 1969.
