Present: Absent: Councilmen Councilmen William Jerome, J.L.McBride, Thomas F. Lam. sen, Milford W. Dahl, Courtney R. Chandler. None Each member of the City Council having received copies of the Minutes of December 21, 1953 reading of the Minutes was dispensed with and approved on motion of Councilman Jerome, seconded by Dahl and carried. In Re Amend. Application Walter E. Tipton etal Reclassify E. 17th St. between Main and the Freeway This being the date set for hearing on the amendment application of Walter E. Tipton etal for the reclassification of the north and south sides of East l?th Street from the existing C-1 and C-2 Districts at Main Street, to and including the four corners of Santiago Avenue for a depth of approximately 150' from the present classifications of R-l, R-2 and C, to the C-1 District. David Hill, 2020 Poinsettia Street, and Curtis S~ Burrow, owner of three lo~s east of the Freeway, gave their reasons for opposing the reclassification and requested that the matter'be taken under advisement. John Daniels, purchaser of the property at 702 E. 17th Street, W.E.Woody, 610 E. l?th Street and Lew Kelly, 2411 Fairmont Avenue favored the property being reclassified to the C-1 District. It was moved by Councilman McBride that the Attorney be instructed to prepare an Ordinance to reclassify the property in accordance with the recommendation of the Planning Commission. Motion was lost. On motion of Councilman Jerome, seconded by Lateen and carried, the Attorney was instructed to pre- pare an Ordinance reclassifying the north and south sides of E. 17th Street from R-l, R-2 and C District to the C-1 District, from Main In Re Bids Cast Iron Pipe Street to the Freeway. . On motion of Councilman McBride, seconded by Jerome and carried, the bids were referred to the Director of Public Works for recommendation. On motion of Councilman Jerome, seconded by Dahl and carried, .the Clerk was authorized to open bids for 1696 lineal feet of 18", Class 150 concrete cylinder pipe with special fittings, as follows: Bid of American Pipe and Construction Co.: Bond in the sum of $1300.00. 1696 lin. ft. 18" concrete cylinder pipe Class 150, price per lln. ft. $6.08 Price quoted is net and includes the applicable Cali~ornia State Sales Tax. On motion of Councilman Jerome, seconded by Dahl and carried, the bids were referred to the Director of Public Works for recommendation. . Communications were read from the Planning Commission recommending that a variance be granted Irvin R. Dawson etux to permit construct- ion of a duplex on the north 52 feet of property at 1134 South Flower Street, and from Assistant Director of Public Works stating that the construction of standard concrete sidewalk and approach are needed in order to bring it up to present city standards. On motion of Councilman Dahl, seconded by Jerome and carried, the recommendation of the Planning Commission was approved and variance granted, subJ eot to the construction of standard concrete sidewalk and approach and that applicant post a $200.00 bond to guarantee the perfoz~nance of the work. Communications were read from the Planning Commission recommending that a variance be g~anted Woodrow W. Tucker to permit the use of property located at 501 East Anahurst Place, excepting the east 55 feet, as a convalescent nursinE home for under six persons, subject to th~ conditions that the type of guests be limited to ambulatory and that no signs be displayed, and from the Assistant Director of Public Works stating that Anahumst Place and Rousselle Street should be paved out to existing paving in order to bring it up to present city standards. On motion of Councilman Dahl, seconded by McB~'ide and carried, the recommendation of the Planning Commission was approved and variance gu'anted subject to conditions as imposed by the Commission and further that the requested improvements have been completed. # It was moved by Councilman Dahl, seconded by Jerome and carried, to reconsider the matter of the Irvin R. On motion of Councilman Jerome, seconded by Larsen and carried, the recommendation of the Planning Commission was approved and variance granted to William Harper to permit property located at 406 East Washington Avenue to be used in the practice of physical therapy, subject to certain conditions as imposed by the Commission. # Communications were read from the Planning Commission recommending that a variance be g~anted George Williams to permit erection of a single story stucco building, about 40~ x 40' in size, with a l0~ driveway, along either side, and a parking area in rear, all black- topped, for the purpose of operating the business of sales and service of radio, television and similar electronic equipment, and from the Assistant Director of Public Works stating that in conform- ance with proposed set-back Ordinanc6 on West First Street, it is recommended the front of building be set no closer than 40 feet to sure, eyed center line. On motion of Councilman Jerome, s~conded by Larsen and carried, the recommendation of the Planning Commission was approved and variance g~anted, subject to the set-back of $0 feet from the surveyed center line. # Communication and Resolution No. 567-A of the Planning Commission were read on the application of Lois Michaels, recommending the reclassification of an area approxima=ely 2.65 acres in size, located on the south side of 17th Street between Fairmont and Lincoln Streets, described as the east 15 fe~t of Block 16 and all of Block 21 of the Town of San~a Ana East, from the R-1 and R-2 Districts to the C-1 District. Communication was read from Assistant Director of Public Works stating that construction of cumb and sidewalks, paving out to existing paving 'on 17th Street and Lincoln Avenue and cons truction of sidewalks on Dorman Street, are needed in order to bring it up to present city standards. On motion of Councilman Dahl, seconded by Larsen and carried, a notice of public hearing was ordered published setting date of hearing as January 18th, 195$. ,, On motion of Councilman Dahl, seconded by McBride and carried, the communication from the Planning Commission approving the proposed procure'ment and dedication of approximately 10 acres, lying west of Bristol Street, for the purpose of development of public park immediately adjacent to proposed Elementary School site, was received and filed. On motion of Councilman Dahl, seconded by McBride and carried, ~he matter was referred to ~he Council and Manager, as a committee, to investigate the possibility of purchase of the property. # On motion of Councilman Jerome, seconded by Dahl and carried, the communication from the Planning Commission stating there is no object- tion to the vacation of certain street easement which is a portion Of Greenleaf Street between Santa Clara Avenue and Bonnie Brae, was received and filed. Christeson for annexation of 11.663 acres located north of Memory Lane and 180 feet west of Flower Street was continued until the next meeting on motion of Councilman Dahl, seconded by Lateen and carried. # With the verbal approval of Donald B. Ohristeson and on motion of Councilman Dahl, seconded by Lateen and carried, action on Tentative Map of Tract No. 2089, submitted by Donald B. Christeson, was con- tinued until the next meeting. On motion of Councilman Jerome, seconded by Dahl and carried, Revised Tentative Map of Tracts Nos. 2018, 2019 and 2020, submitted by Baker Development Company, covering eighty-four lots located north of East 17th Street between Grand and Linwood Avenues, was approved on recommendation of the Planning Commission and the Director of Public Works. # At the request of Jim Guthrie, representing ~he sellers of the sub- division, and on motion of Councilman Dahl, seconded by Jerome and carried, action on Tentative Map of Tracts Nos. 2068, 2069 and 2070, was continued until the next meeting. # Communication was read from the Planning Commission recommending that a variance be granted Frank R. Hilditch etal to permit a reduction in the front set-back to 25 feet on Lots 1 to 8 inclusive, Tract No.1965, located on the west side of Larchmont Street. The Council having unanimously waived the reading of the Resolution, on motion of Council- seconded by Lateen and carried, the following Resolution man Dahl, entitled: "Resolution No. 54-1 granting a variance on variance application No. $5$ where City Council made change in the area affected as shown by Planning Commission Resolution No. 571-A" to permit a reduc~ion in the front set-back on Lots 9 through 29, both inclusive, of Tract No. 1965 and that the requested reduction in front set-back on Lots I through 8, both inclusive, of Tract No. 1964 be denied, was considered and passed by the following vote: Ayes, Councilmen NOeB, Absent, Councilmen Councilmen William Jerome, J.L.McBride, Thomas F. On recommendation of the Director of Public Works and on motion of Councilman McBride, seconded by Jerome and carried, the bid of the American Pipe and Construction Company, in the sum of $10,311.68 was accepted for the furnishing of 1696 lineal feet of 18" Class 150 concrete cylinder pipe with special fittings, and all other bids were reJ eot ed. Communication of the Chamber of Commerce was read submitting a petition for the formation of a vehicle parking distrlc~ under the provisions of the Vehicle Parking District Law of 1943. On motion of Council- man Lateen, seconded by Dahl and carried, the petition was received, filed and referred te ~he Clerk for checking the assessed value of each property parcel of land and t2~e/ owner's names and addresses, in the district bounded on the sough by Fourth Street, on the east by Spurgeon Street, on the north by Seventh Street and on the west by Main Street. Communication was read from the Public Utilities Commission granting an extension of time to September 30, 1954, in the matter of the application of the City of Santa ADa for an Order authorizing the re- location of a crossing numbered 6N-35~94-C and a new crossing over the right of way of the Pacific Electric Railway Company at Orange AveDue Just south of Adams Street. On motion of Councilman Jerome, seconded by Lateen and carried, the claims of Mona C. Lindawood, 910 French Street, for alleged injuries sustained when her foot caught on the corner of a ~ash can at the corner of Fourth and Sycamore Streets, and of Ida M. T e~-hune, 234~ 0akmont, in the sum of $580.00, for alleged injuries sustained when she fell on the defective sidewalk at North Main and Buffalo Streets, were referred to the At$orney and Insurance Carrier. Dahl was appointed an alternate member of the Board of Directors of County Sanitation District No. 2. # Copy of communication was read from the Division of Highways, Depart- ment of Public Works, advising that Resolution of relinquishment of a portion of Road VII-ORA-2-SA, along First Street, between the easterly line of Main Street and the easterly city boundary of Santa Ana, at Mabury Street, was recorded December 7, 1953, in Book 2628, Page 232, of Official Records of Orange County. On motion of Councilman Dahl, seconded by Jerome and carried, the Oommunication was received an~ filed. # On motion of Councilman Jerome, seconded by McBride and carried, proper officials were authorized to execute Utilities Agreement No. 7- Ut-397 with the Division of Highways, in connection with the re- location of water facilities on the Santa Aha Freeway between B~oadway and First Street. # Communication was read from the Assistant Director of Public Works advising that improvements within Tract No. 1734 have been completed, and on motion of Councilman Jerome, seconded by Dahl and carried, bond filed by Russell Nelson, President, Flower Estates, Inc., in the sum of $40,000.00, was ordered released. . (stop sign) In Re Checking Petition (Vehicle Parking District) The Council having unanimously waived the reading of the Resolution, on motion of Councilman McBride, seconded by Jerome and carried, the following Resolution entitled: "Resolution No. 54-3 concerning parking limitations and curb markings in accordance therewith" establishing a green zone on the east side of French Street between Third and Fourth Streets, in accordance with the request of Graybar Electric Company, was considered and passed by the following vote: Ayes, Councilmen William Jerome, J.L.McBride, Thomas F. It was moved by Councilman Jerome, seconded by Larsen and carried, that B.J.Barletta, Maintenance Engineer of the Joint Outfall Sewer, be authorized to sign an affidavit on behalf of the City of Santa Ana to state that all propane delivered to the tanks at the Joint Outfall Sewer Treatment Plan~ has been or will be used to fire the boiler and that none has been used to move a vehicle on any public highway and that all propane new on hand will be used in the same manner and the tanks removed within thirty days. # On recommendation of ~he committee and on motion of Councilman Jerome, seconded by Dahl and ~arried, the request of Miss Mary Snyder that signs be installed prohibiting school cars pa~king on Walnut Street between Van Ness and Pa~ton and on South Van Ness Street between First and Walnut was denied. # On recommendation of the committee and on motion of Councilman Dahl, seconded by Lateen and carried, the request of Donald R. Warren Co., on behalf of United States Rubber Co., for a 40-foot driveway for the main entrance on Dyer Road, was g~anted subject to the installation of a concrete approach. # At the request of the Ac~ing Chief of Police and on motion of Council- man Dahl, seconded by Jerome and carried, action was continued until next meeting on the request of the Lincoln School P.T.A. that a stop sign be installed at 15th and French Streets. On mo~ion of Councilman Dahl, seconded by Lateen and carried, the Clerk was authorized to retain assistance, on a reasonable basis, on the checking of the assessed value of each parcel of land and ~he property owner's names and addresses, in the district bounded on ~he south by Fourth Street, on the east by Spurgeon Street, on the north by Seventh Street and on the west by Main Street, for the formation of a vehicle parking district. # On motion of Councilman Lateen, Council adJourned.
