THROUGH THE CITY ATTORNEY, TO PARTICIPATE IN AMICUS
CURIAE BRIEF IN THE CASE, BISHOP v. CITY OF SAN JOSE
WHEREAS, the case of Bishop v. city of San Jose (1 civil
24764, Court of Appeal, First Appellate District, Division Two)
draws in issue a point of considerable interest to all munici-
palities; and
WHEREAS, an amicus curiae brief is being prepared to state
the position of interested cities to the California Supreme Court;
and
WIqEREAS, the City of Santa Ana shares the concern of other
municipalities that the ruling of the District Court of Appeal in
the Bishop case might stand;
NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
participate, through the office of the City Attorney, in the prepa-
ration and submission of the amicus curiae brief to the Supreme
Court in the Bishop v. City of San Jose case, in order that the
ruling of the District Court of Appeal might be judicially
corrected;
BE IT FURTHER RESOLVED: That the City of Santa Ana may
expend funds not to exceed $250.00 in this undertaking.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 5th day of May, 1969.
