None Dahl, Each member of the City Council having received copies of the Minutes of January 18th and January 23th, 1954, reading of the Minutes was dispensed with and approved on motion of Councilman Jerome, seconded by Dahl and carried. Application Thelma Oood~,,? n Reclassify property No. side 15th btn College Ave. and Eng_~.lsh St. application of Thelma Goodwin for the reclassification of property situated on the north side of 15th Street between College Avenue and English Street, from the R-1 District to the R-2 and R-3 Districts, the Clerk read two communications from Ellis C. Diehl, Vice President, College Crest, Inc., protesting the action of the Planning Commission and requesting that the Council deny the application for rezoning any lots facing 15th Street between College Avenue and English Street to the R-2 or R-3 Districts, and stating there is no objection to a zoning to multiple family use of two or three lots adjoining the Church property but good planning would require that the property along the north side of 15th Street westerly of these two or three lots should remain in the single family zone. Also, protest was read of Burwell C. Palm, 10a East 8th Street, on behalf of two insurance companies which have committed themselves to make in excess of one million dollars worth of "G.I." loans, in connection with purchases by veterans of homes in the "College Crest" tract, immediately south of the land covered by the re-zoning application and requested the re-zooing be denied. On motion of Councilman Dahl, seconded by Larsen and carried, the communications were received and filed. Wilfred B. Taylor, spokesman, and Orville P. Goodwin, owners of portions of the property, and as trustees for seventeen persons who have equities in the property, stated reasons why the application should be granted. This being the date set for hearing on the amendment application of Cecil DeVote for the reclassification of property situated on the east side of Baker Street between Edinger and Berkeley Streets, described as Lots I to 12, both inclusive, from the R-1 District to the R-3 District, Robert J. Zitnik, 1433 South Baker Street, Raymond C. Von Felden, 1430 South Baker Street and Andrew Bayer, 1437 South Baker Street expressed their reasons for objecting to the construction of In Re Variance Fred E. Andrew Beyer presented a petition ~ containing fourteen signatures of property owners protesting the recommendation of the Planning Commission to rezone the area. On motion of Councilman Dahl, seconded by Larsen and carried, the petition was received and filed. Cecil DeVote presented a letter from Attorneys Wallace and Cashin stating they will prepare an agree-I ment for the Archdiocese of Los Angeles Education and Welfare Corpor-i ation in the matter of the dedication of a strip of land on the west side of Baker Street between Edinger and Berkeley Streets if Mr. DeVote will install and pay for curbs, sidewalks and pavement, which was agreeable to the subdivider. On motion of Councilman Dahl, seconded by McBride and carried, the communication was received and filed. It was moved by Councilman McBride, seconded by Larsen and carried, ~ that the recommendation of the Planning Commission be approved and the Attorney was instructed to prepare an Ordinance to reclassify the property from the R-1 District to the R-3 District, as applied for. On motion of Councilman Jerome, seconded by Larsen and carried, the recommendation of the Planning Commission was approved and variance granted to Fred E. Smith and J. B. Sommers, to permit the use of property at 1425 West First Street for a general contracting business, subject to certain conditions as imposed by the Commission. The Manager requested that the Council reconsider the plans filed involving the possible encroachment of the street area of the building owned by Dr. Edward A. Miller, 309 West 8th Street, located at the northwest corner of 8th and Broadway and recommended a minute order permitting the Building Department to allow encroachment in the stree~ area of not more than 3" and less, if possible. On motion of Council- man Jerome, seconded by Dahl and carried, the recommendation of the Manager was approved and the Chief Building Inspector authorized to issue encroachment permit. On motion of Councilman Jerome, seconded by McBride and carried, the recommendation of the Planning Commission was approved and variance granted to Milton P. Cook to permit the use of property at 435 South i Broadway for conduct of a real estate office in building now existing on the property, subject to certain conditions as imposed by the Commission. On motion of Councilman Larsen, seconded by Dahl and carried, the recommendation of the Planning Commission was approved and variance granted to B. Harold Rothwell to permit the use of property at 2101 South Sycamore Street for conduct of business of television and radio ~ repair work and for the sale of repair parts, subject to conditions as imposed by the Commission. Communications were read from the Planning Commission recommending that a variance be granted Charles C. Camarata to permit the use of property at 1126 East Washington Street for storage of brick, cement blocks, lumber and similar rough building materials, the one existing building to be used as an office, and from the Assistant Director of In Re Variance Patrick P. Public Works stating that a sidewalk across the property and concrete approaches are needed in front of or along side the property in order to bring it up to the present City standards. On motion of Councilman Jerome, seconded by Larsen and carried, the recommendation of the Planning Commission was approved and variance granted, subject to the improvements as imposed by the Assistant Director of Public Works. . On motion of Councilman Larsen, seconded by McBride and carried, the recommendation of the Planning Commission was approved and variance granted Patrick P. Prizio to permit the use of property at 817 North Patton Street for construction of a twelve-unit two-story apartment house with garages and ample turning room in the alley. Communication was read from the Planning Commission recommending denial of variance application of Robert M. Holt to permit the use of prop- erty at 1832 South Flower Street for the operation of an upholstering and drapery shop, and on motion of Councilman McBride, seconded by Dahl and carried, the recommendation of the Planning Commission was approved and variance denied. . Communications were read fro~ the Planning Commission recommending that a variance be granted The Presbytery of Los Angeles to permit the use of property situated at 940 Wilshire Avenue, for the construction of a church, and from the Assistant Director of Public Works stating that the paving out to existing pavement on Wilshire Street, construct- ion of sidewalk and combination curb and gutter across the property are needed in front of or along side the property to bring it up to the present city standards. .On motion of Councilman Dahl, seconded by Larsen and carried, the recommendation of the Planning Commission was approved and variance granted subject to the dedication and improve- ment of the north 30 feet of the Droperty on Wilshire Street and to the improvements as imposed by the Department ~of Public Works. On motion of Councilman Dahl, seconded by Larsen and carried, the reque~ of the Bible Center Church to erect a directional sign 18"x24" on the southwest corner of the intersection of North Main and Fifteenth Streets, in the area between ~he curb and sidewalk, was granted sub- Ject to the condition that the sign be erected on the Fifteenth Street right-of-way and under the direction of ~he Dept. of Public Works. On motion of Councilman Jerome, seconded by McBride and carried, the request of the M and S Maintenance and Construction Company for a permit to construQ~ two driveways for service station at 2026 South Flower Street, one 35' wide and the other 30~ wide with a 20~ separator, for the Santa Ana Oil Company, was referred to the curb usage committee for recommendation at the next meeting. ,, On motion of Councilman Jerome, seconded by McBride and carried, the request of Lloyd Shearer for a loading zone at ~ll West Third Street, was referred to the curb usage committee for recommendation at the next meeting. , On motion of Councilman Dahl, seconded by Larsen and carried, the effective February ],1954 resignation of E. C. Communication was read from the Department of Public Works advising that improvements within Tract No. 1740 have been completed, and on motion of Councilman Dahl, seconded by McBride and carried, bond filed by Emmet C. Rogers, in the sum of $15,000.00, was ordered re- leased and improvements accepted as completed. On motion of Councilman Dahl, seconded by Jerome and carried, copy of communication of the Director of Public Works to the State Division of Highways requesting~ that a 12 inch vitrified clay pipe sewer be constructed across the Freeway at approximately station 385475 where the north and south property line crosses the Freeway, was received and filed. Wast, in the sum of $30~00, to cover the cost of cleaning up trash and refuse blow~ from the City Dump during the month of December onto his property at 16172 South Harbor Boulevard, were referred to the Manager with authority to imm e di at ely. On motion of Councilman Dahl, seconded by Larsen and carried, Decision No. ~9565 before the Public Utilities Commission to investigate on the Commission's own motion, to establish a list of grade crossings of railroads and city, county, or city and county highways ur~ently in need of improved protection and to determine the nature of needed improved protection at such crossings, was referred to the Manager for report. On motion of Councilman Dahl, seconded by Jerome and carried, the application of the Pacific Greyhound Lines before the Public Utilities Commission for authority to operate bus service between the Junction of U.S. Highway 101 and Santa Clara Avenue, Santa Ana, and the Junction of U.S.Highway 101 and extension of First Street, Santa Aha, over an alternate route, was received and filed. On motion of Councilman McBride, seconded by Dahl and carried, the excerpt from the Minutes of the Board of Supervisors, dated January 19th, 195~, was received and filed, advising that the request of the City of Santa Aha to dispose of dirt and broken concrete on Santa Ana River Levee Dikes was approved as recommended by the Orange County Flood Control Engineer. On motion of Councilman McBride, seconded by Dahl and carried, the notification of the State Board of Equalization of alcoholic beverage application of Gonzalo Mendez, 1211 E. 1st Street, was received and filed. On motion of Councilman Jerome, seconded by McBride and carried, the application of Vern C. Henshaw to drive taxicabs, was received, filed and permit granted. On motion of Councilman McBride, seconded by Jerome and carried, ~he annual report for 1953 of the Fire Department was received, filed and referred to the Council as a whole. On motion of Councilman McBride, seconded by Jerome and carried, the communication from the Shoreline Planning Association of California, Inc., reference oil royalty revenue fund established for acquisition of both beaches and inland, park sites, was received and filed. On motion of Councilman Jerome, seconded by Dahl and carried, the request of R. E. Bowyer to remove seven feet of curbing at 1205 West Fifth Street in order to make one driveway 44~ 11" long, was referred to the curb usage committee for recommendation at the next meeting. On motion of Councilman Jerome, seconded by Dahl and carried, the request of the First Methodist Church that a cross-walk be painted in the middle of the block on Sixth Street between French and Spurgeon Streets, was referred to the curb usage committee for report at the next meeting. On motion of Councilman Dahl, seconded by Larsen and carried, the request of John R. Dreuntel for permission to operate the billiard parlor and smok~ shop at g05 West Fourth Street, was referred to the Manager and Acting Chief of Police for recommendation. On motion of Councilman Jerome, seconded by Dahl and carried, the following Ordinance entitled: "Ordinance amendin~ Santa Ana Municipal Code by amending Article IX thereof creating changes in district boundaries and by amending ~heet Number 6 of the Districting Map to show the reclassification" of an area approximately 2.65 acres in size, located on the south side of 17th Street between Fairmont and Lincoln Streets, described the northerly 300 feet of northerly 300 feet a~_/the east 15 feet of Block 16 and the/of Block 21 of the Town of Santa Ana East, from the R-! and R-2 Districts to the C-1 District, in accordance with amendment application of Lois Michaels, was intro- duced, considered and placed on file for second reading. # On motion of Councilman Jerome, seconded by Larsen and carried, the following Ordinance entitled: "Ordinance establishing set-back lines on each side of East First Street from the Santa Fe tracks to the e~sterly city limits by amending subparagraph (f) of Section 9150, Part 2, Chapter l, Article IX of Santa Ana Municipal Code" was introduced, considered and placed on file for second reading. None None Dahl, The Council having unanimously waived the reading of the Resolution, on motion of Councilman McBride, seconded by Dahl and carried, the following Resolution entitled: "Resolution No. 5~-14 A Resolution of the City Council of the City of Santa Ana approving an agreement relating to the granting of permission to Orange County Sanitation District No. 6 and the Midway City Sanitary District to connect their sewage disposal system and lines to the trunk sewer lines and sewage disposal system and treatment plant of the Orange County Joint Out fall Sewer and to discharge sewage therein, and approving and authorizing the execution of agreements to be made and entered into by and between Orange County Sani%atlon District No. 6 and Midway City Sanitary District and the Oities and Sanitary Districts of the Orange County Joint Outfall Sewer" was considered and passed by the following vote: Ayes, Councilmen William Jerome, J. Noes, Councilmen None Absent, Councilmen None On motion of Councilman Dahl, seconded by Larsen and carried, Tentative Map of Tract No. 1939, situated north of West Orange Road and west of Flower Street, consisting of 111 lots, submitted by Louis Schulman, was approved subject to the condition that the subdivider provide for proper surface water drainage without passing it onto private land, proper sewage disposal be provided for and that comb- ination curb and gutters be installed; also, that the street names of either Fanwood Drive or Fernwood Drive be changed and Fernwood Drive In Re ,Map of Tract ~No. 1575 be extended northerly to the north property line. On motion of Com~cilman Dahl, seconded by Lateen and carried, an extension of thirty days time was granted th'e Quality Land Company'on In Re Bonds for City employees Map of Tract No. 1575. . The Manager requested authority, by minute order, to negotiate for the re-writing of bond coverage without formal bid procedure for various city employees which is required by provisions of the Charter and by Ordinance. On motion of Councilman Dahl, seconded by Jerome In Re JRequest United Cerebral Palsy Assoc. and carried, the Manager was ~anted authority to negotiate for bond coverage. # The Manager stated that he received a request from the United Cerebral Palsy Association for cancellation of the charge in the sum of $6.50, representing rental of the committee room at the Community Center Clubhouse.
