HomeMy WebLinkAbout69-148RESOLUTION 69-148 DELETING CONDITION NO. 2 IMPOSED BY THE PLANNING COMMISSION IN GRANTING A VARIANCE ON VARIANCE APPLICATION 69-56 FILED BY ROHRS INVESTMENT COMPANY WHEREAS, after public hearing on notice, the Planning Commission has granted a variance on variance Application 69-56 filed by ROHRS INVESTMENT COMPANY to modify plans and conditions of an approved shopping center by permitting a restaurant and an additional 35-foot high pole sign at 1241 East 17th Street, Santa Ana, california, in a C-4 District, subject to certain conditions; and W~EREAS, Appeal Application No. 224 was duly filed by Rohrs Investment Company appealing Condition Number 2 attached to the approval of said variance 69-56, which condition prohibited the installation of a freestanding sign on the subject property; and WHEREAS, after public hearing on notice, the City Council has determined that Condition No. 2 should be deleted from the conditions of approval of said Variance 69-56; NOW, THEREFORE, BE IT RESOLVED: That the city Council of the city of Santa Ana does hereby overrule the decision of the Planning Commission and does hereby grant a variance on variance Application 69-56, filed by ROHRS INVESTMENT COMPANY to permit a sign not to exceed 180 square feet per face, a maximum of a 5-foot projection, and a maximum height of 35 feet, in lieu of the free- standing sign heretofore approved for construction at the intersection of 17th Street and Grand Avenue per variance Application 68-9; said Variance is granted subject to the following conditions: 1. That a revised plot plan be submitted to and approved by the Planning Department indicating the offstreet parking stalls east of the restaurant be so designed that there will be no direct access to the major access on Seventeenth Street to the shopping center, and that the development be according to the revised plot plan except for minor modifications approved by the Planning Department; 2. That roof or fin signs shall be p~mitted on the proposed structure and that any signs shall not exceed an area equal to 20% of the building elevation to which the sign is attached; 3. That all mechanical apparatus be baffled for sound and attrac- tively screened from view; That a.landseape plan be submitted to and approved by the Planning Department and that said plan be implemented and consist of a balanced combination of trees, shrubs and ground cover; 5. That a complete system of underground electrical and telephone utilities be provided. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: e Furnish the Department of Public Works a final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets when this property is developed; Submit a revised plot plan showing no new drive and omitting three parking stalls adjacent to the future service station and adjacent to Seventeenth Street for on-site vehicular circulation - to be approved by Public Works Department. -1- THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 8. Provide sanitary sewer facilities as required by the Department of Public Works. NOTE: Lateral will be required to Grand Avenue.
