Present: Absent: Councilmen Councilmen William Jerome, J.L.McBride, Thomas F. Lateen, Courtney R. Chandler. Milford W. Dahl Each member of the City Council having received co?les of the Minutes of June 7th, 195~, reading of the Minutes was.dispensed with and approved on motion of Councilman Jerome, seconded by Lateen and carried. In Rej Hearing "Frank Borchard Annex No. l" Ordinance Declaring Annexation This being the date ~et for hearing protests on annexation to the City of certain uninhabited territory designated "Frank Borchard Annex No. 1", the protest of J. Ogden Markel, 18lb South Patton Street was read, and on motion of Councilman Jerome, seconded by Lateen and carried, the communication w~s received and filed. On motion of Councilman Jerome, seconded by Larsen and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated "Frank Borchard Annex No. l" In Re Hearing "Antone Borchard Annex" Ordinance Declaring Annexation was introduced, considered and placed on file for second reading. , This being the date set for hearing protests on annexation to the City of certain uninhabited territory designated "Antone Borchard Annex", no protests were received, On motion of Counci2man Lateen, seconded by Jerome and carried, action was deferred until the next meeting on the Ordinance approving the annexation, for further inform- ation as to whether or not the Pacific Electric Railway intends to pursue its application for removal of the tracks on Fourth Street, InRe !Amend. On motion of Councilman Jerome, seconded by M~Bride and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code creating changes in district boundaries and amending Sheet No. 6 of the districting map to show the reclassification" was introduced, considered and placed on file for second reading. Communication was read from the Planning Commission recommending approval of the proposed establishment of a setback line along the north side of Santa Clara Avenue, from Broadway to Main Street, 59' north of the surveyed center line of Santa Clara Avenue measured at right angles. ' The Council having unanimously waived the reading of the Resolution, on motion of Councilman Larsen, seconded by McBride and carried, the following Resolution entitled: "Resolution No. 55-84 declaring intention to establish setback lines on Santa Clara Avenue from Broadway to Main Street" was considered and passed by the following vote: Ayes, Councilmen William Jerome, J.L.McBride, Thomas F. Dahl Chandler Communication was read from the Planning Commission recommending denial of variance applicatio~of George Viebeck to permit the erection of a duplex on property situated on the west side of Bristol Street (83'), and the north side of Santiago Creek (250'), between Seventeenth Stree~ and Memory Lane. On motion of Councilman McBride, seconded by Jerome and carried, the recommendation of the Planning Commission was approved and variance denied. Communications were ~ead from the Planning Commission recommending grant~ ing of variance to George L. Wild to build an addition to existing house on property at 503 East St. Gertrude Street, so that a variety store and dry cleaning pick-up agency or drug store, or beauty parlor, or real estate office may be housed therein, with a door opening into it from the living room of the house; and, also to 8onvert an unfinished garage into a small three-room apartment, and, from the Department of Public Works that construction of curb and sidewalk and paving out to existing pavement on St. Gertrude Place and Rousselle Street are needed in front of or along the side of the property to bring it up ~o the present City standards. Attorney Roy Giordano, on behalf of his client~ stated that a variance was granted on this property in 1947 and since theft time the lots have been refaced. On motion of Council~ man Jerome, seconded by Larsen and carried, the recommendation of the Planning Commission was aoproved and variance ~Nrant~d subject to the conditions as i~posed by the Department of Public ~orks. ,, Communication of the Planning Commission was read submitting Resolution No. 642 recommending the reclassification of three lots situated 180~ south of Elm Street, with 229~ frontage on Bristol Street, from R-1 to~ R-2 District, in accordance with amendment application of Donald B. On motion of Councilman McBride, seconded by Jerome and carried, Map of Tract No. 2089, submitted by Donald B. Ckristeson, was approved for the dedication of Memory Lane, Sherwin Lane, Leonard Lane, Freeman Lane, Lowell Lane, and Olive Lane, subject to the filing of a satis- factory bond to have included within the coverage "drainage ditches", and the agreement covering improvements was ordered signed. On motion of Councilman McBride, seconded by Larsen and carried, Map of Tract No. 1790., submitted by Meyer-Nash and Associates, a co- partnership composed of GEorge S. Fruehling, John H. Lows, Stanley E. Nash. and HenrY D. Meyer, was approved for the dedication of Eastside Avenue, Wright Street and Patricia Lane, subject to the revision of the bond to the satisfaction of the City Attorney, and the agreement covering improvements was Ordered signed. Communication was read from the County of Orange advising that the County Tax Collector will sell at public auction Lot 23, Block C of Tract 233, and Lot ~, Block 12 of Tract 560, located on Oak Street between St. Gert'rude Place and Anahurst, and on the southwest corner of Artesia and WeSt Myrtle Street. On motion of Councilman. McBride, seconded by Jero~e and carried, the Clerk was instructed to notify · ~he Tax Collectog that.the City consents to the sale of such property. Adix, 1126 Orange Avenue, pro-. testing the dry weeds and trash on lot located on the northwes$ corner! of Orange and McFadden Street, and on motion of Councilman Jerome, seconded by Larsen and carried, the communication was received and filed as the matter has been taken care of by the Fire Department. On motion of Councilman Jerome, seconded by McBride and carried,the claim of Homer L. Haney, in the sum of $20,000.00, for alleged inJurie sustained when he stepped on the edge of a hole which had been allowed to remain in the sidewalk, at 1305 West Fourth Street, was referred to the Attorney and Insurance Carrier. At the request Of the Purchasing Agent and on motion of Councilman Larsen, seconded by Jerome and carried, the Clerk was authorized to advertise for bids for the furnishing of rock and plant mix for the repaying of Third Stree$ from Ross to Spurgeon Streets; bids to be opened July 6th, 1954. Communication was read from Fraternal Order Eagles requesting permissi n to secure permits for the sale of fireworks at stands to be located the corner of Fairview and Bristol and at 2059 South Main Street, due · On to the fact that the time for application for permit has expired. motion of Councilman McBride, seconded by Jerome and carried, the request was granted subject to the approval of the Fire Department Conununication was read from L.M.Guyon stating that the Police Depart- ment is continuing to furnish motor escort service for the mortuaries and requesting information as to whether there is a law preventing a municipality competing in business with a private enterprise. Registry, was received, filed and referred to the Manager for recommendation. # Councilman Dahl arrive~ at 8:35 P~M. # On motion of Councilman Dahl, seconded by Jerome and carried, the Notice of exercise of option to renew lease dated February l, 1952, ~ bel~ween the City and the County of Orange, for the Superintendent of Schools, for rental of certain rooms, and the Audio Visual Building, a~ ll04 West 8th Street, was received, filed and referred to the Attorney. # Communication was read from the Department of Public Works advising that improvements within Tract No. 1716 have been completed, and on motion of Councilman Jerome, seconded by Dahl and carried, bond filed by Louis Schulman, in the sum of $13,020.00, was ordered released and. improvements accepted as completed. On motion of Councilman Larsen, seconded by Jerome and carried, the communication from A. Hamon, 1501 Durant Street, stating that he over. heard the remark of two ou~-of-~ businessmen ghat the streets in Santa Ana are too narrow for property investments, was received and filed. On motion of Councilman. Dahl, seconded by Larsen and carried,.the resignation of J.A.Harvey, Jr., as a member of the Civilian Defense Council and Disaster_/ was received, filed and ~he Civilian Defense GoQrdinator instructed to write a letter of thanks to Mr. Harvey for his services. # Communication was read from Courtney R. Chandler, Chairman, Civilian Defense and Disaster Council, expressing to the Council the appreciat3 on of all members of the Defense Council for the fine work and results obtained by the Civilian Defense Coordinator, Colonel E.J.McCabe, and on motion of Councilman Larsen, seconded by Dahl and carried, the communication was received and filed. # Communication was read from Byron-Jackson Company requesting a thirty day extension on the completion of the Bristol Street pumping plant installation. On recommendation of the Acting Director of Public Works and on motion of Councilman Larsen, seconded by Jerome and carried, the extension of thirty days was denied. Communication was read from O. Henry, 6451-55 Long Beach Boulevard, Long Beach, with reference to the worthiness of Harry I. It was moved by Councilman Jerome, seconded by Larsen and carried, that escrow instructions be approved for purchase of property located at 633-633~ North Van Ness Street, from Stella M. On'motion of Councilman Lateen, seconded by Dahl and carried, the recommendation was approved and contract awarded to the Electric Supplies Distributing Company, all other bids rejected, check ordered returned and proper officials authorized to execute contract. The Manager recommended that the bid of the Santa Aha Independent be accepted for the publication of legal notices and other matters required by law to be published, for the fiscal year beginning July let, 1954 and ending June 30th, 1955. On motion of CounCilman Dahl, seconded by Jerome and carried, the recommendation was approved'and contract awarded to the Santa Ana Independent and all other bids rejected. .# The Manager requested confirmation of the appointments of the follow- ing Service Chiefs and Alternates in accordance with the provisions of Resolution No. 4081, Oivil Defense and Disaster Resolution, and Tab "C" of the City of Santa Aha Civil Defense and Disaster Plan: Communications Service: ~Chief - James J. (See Minutes July 6th, 1954) In Re Prohibition of septic tanks.or ~esspools In Re Monies received from County Sanitation Districts 2 and 3 On motion of Councilman Lateen, seconded by McBride and carried, the matter of the annexation designated "Santa Ana Gardens", was submitted to the Council~as alwhole to take under advisement. ,, Communication was read from the Attorney advising that the letter from The Salvation Army contains all of the information required by the Code provisions, and recommended that a Continuing Special License be considered. On motion of Councilman Dahl, seconded by Lsu~sen and carried, the Continuing Special License for use of public place or way was granted. On motion of Councilman Dahl, seconded by McBride and carried, the Ordinance amending Section 9116 of the Santa Ana Municipal Code to increase the fees on variances and zone changes, as prepared by the Attorney, was referred to the Planning Commission in order ~hat a public hearing may be held. Michael Garcia, 2118 Maple Street, owner of property on West 8th Stree' between Hawley and King Streets stated that septic tanks are in use in the area and requested that the City install a sewer system. On motion of Councilman McBride, seconded by Dahl and carried, the matter was referred to the Manager and Acting Director of Public Works to determine if it is possible for the City to construct a sewer system on West 8th Street between Hawley and King Streets. On motion of Councilman Dahl, seconded by Lateen and carried, proper officials were authorized to execute agreement dated June 21st, .1954, between the City and the Orange County Peace Officers Association, Inc , providing for the use of the target range facilities at the tr~aining center located on Struck Avenue Just east of the Santa Ana River. ~ It was moved by Councilman McBride, seconded by Dahl and carried, that the question of amending Chapter 5, Section 7500 of the Municipal Code be referred to the Chief Building Inspector, Attorney and Acting Director of Pu61ic Works to consider prohibition of septic tanks or cesspools in the City. The Manager recommended that the amount of $139,112.10 received from the County Sanitation Districts 2 and 3 for prepayment on Term Agreement for purchase and sale of sewtge facilities be held in suspense until . July let and be recorded as a revenue for the fiscal year 1955-55 and that such revenue be distributed as follows: $121,437.10 be allocated to Fund 62 City Hall Acquisition and Construction and that the remaind r of $17,675.00 be allocated in various amounts to the Bond Interest and Redemption Funds in accordance with the Budget to be adopted for the fiscal year 195~-55. It was moved by Councilman Lateen, seconded by Dahl and carried, that the recommendation of the Manager be approved. On motion of Councilman Jerome, seconded by Dahl and carried, the City 1954, at 7:30 P.M., in the Council adjourned to Monday, June 28th, Council Chamber.
