HomeMy WebLinkAbout70-061RESOLUTION 70-61 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR THE WIDENING AND IMPROVEMENT OF FIRST STREET BETWEEN BAKER AND BIRCH STREETS WHEREAS, portions of First Street as they now exist within the city of Santa Ana are inadequate in width to accommodate the increased flow of east-west traffic and it has become necessary to widen and improve those portions of said street; and NOW, THEREFORE, BE IT RESOLVED; That the city Council of the city of Santa Ana does hereby find and declare that the public interest and necessity require that First Street be widened and improved between Baker and Birch Streets to accommodate the increased flow of east-west traffic and further require that said city do have, take, and acquire for street purposes that certain real property in the City of Santa Ana, County of Orange, State of California, described as follows: PARCEL 1: Lot 9 in Block 5 of "Baldwin's Addition to the Town of Santa Ana", in the city of Santa Ana, as shown on a map recorded in Book 29, Page 74 of Miscellaneous Records of Los Angeles County, california. PARCEL 2: Lots 10 and 11 in Block 5 of "Baldwin's Addition to the Town of Santa Ana," in the City of Santa Ana, as shown on a map recorded in Book 29, Page 74 of Miscellaneous Records of Los Angeles County, california. EXCEPT the East 40.9 feet of said Lot 11. PARCEL 3: Lot 3 in Block 1 of Crane's Subdivision of Blocks 1 and 2 of Salisbury's Addition to Santa Ana, in the City of Santa Ana, as shown on a map recorded in Book 1, Page 50 of Miscellaneous Record Maps, records of Orange County, California. PARCEL 4: The Southerly 40 feet of Lot 4 and of Lot 5 in B~ock 1 of Crane's Subdivision of Blocks 1 and 2 of Salisbury's Addition to Santa Ana, in the City of Santa Ana, as shown on a map thereof recorded in Book 1, Page 50, of Miscellaneous Record Maps, records of said Orange County. PARCEL 5: Lot 7 in Block B of Hutchin's Subdivision, in the City of Santa Ana, as shown on a map recorded in Book 3, Page 18 of Miscellaneous M~ps, records of Orange County, california. PARCEL 6: The West 37 feet of Lot 11 and the East 6 1/2 feet of lot 10 in Block "B" of "Hutchins subdivision", in the City of Santa Ana, as shown on a map recorded in Book 3, Page 18 of Miscellaneous Maps, records of Orange County, california. PARCEL 7: Lot 12 and the East 13 feet of Lot 11, Block B of Hutchin's Subdivision, in the city of Santa Ana, as shown on a map thereof recorded in Book 3, Page 18, Miscellaneous Maps, Records of said Orange County. - 1 - PARCEL 8: PARCEL 9: The East half of Lot 7, and the West half of Lot 8 in Block L of Ross Addition to the Town of Santa Aha, in the City of Santa Ana, as shown on a map thereof recorded in Book 3, Page 534, Miscellaneous Records of Los Angeles County, California, also as shown on a corrected map of Blocks "L", "M", "N", "0", and "P" of said Ross Addition, recorded in Book 1, Page 45, Record of Surveys, in the office of the County Recorder of said Orange County. The east half of Lot 8 and the West 12.5 feet of Lot 9 Block L of Ross Addition to Santa Aha, in the City of Santa Aha as shown on a map thereof recorded in Book 3, Page 534, Miscellaneous Records of Los Angeles County, california. PARCEL 10: A. PARCEL 11: in The Southerly 40 feet of the East half of Lot 8 and the Southerly 40 feet of Lots 9 and 10 in Block "K" of "Ross Addition to Santa Aha", in the city of Santa Ana, as shown on a-map recorded in Book 3, Page 534 of Miscellaneous Records of Los Angeles County, california. A spandrel shaped parcel of land bounded on the East by the East line of said Lot 10 in Block "K" of "Ross Addition to Santa Ana", bounded on the South by the North line of the above described Parcel 10 A, and bounded Northwesterly by the arc of a curve concave Northwesterly, having a radius of 25.00 feet and tangent to said South and East boundaries. That portion of Lot 4 in Block 9 of the "Jacob Ross Tract in the Ross Addition to the Town of Santa Ana", in the City of Santa Ana, as shown on a map recorded in Book 5, Page 582, of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at the Southeast corner of Lot 4 in Block 9 of said Jacob Ross Tract, being also the Northwest corner of First and Parton Streets; running thence West along the North line of First Street, 125 feet to the Southwest corner of said Lot 4; running thence North along the line between LOts 3 and 4 in said Block 9 of the Jacob Ross Tract, 61.375 feet to a point; thence East to a point in the East line of said Lot 4 being also the West line of Parton Street, distant 61.75 feet north of the Southeast corner of said lot 4; running thence South along the East line of said Lot 4, being the West line of Parton Street, 61.75 feet to the point of beginning. PARCEL 12: A. PARCEL 12: B. The Southerly 40.00 feet of Lot 6 and of Lot 7 in Block 8 of Dawson and Cummings Additions to the Town of Santa Ana, in the City of Santa Ana, as shown on a map thereof recorded in Book 13, Page 47, Miscellaneous Maps, records of said Orange County. A spandrel shaped parcel of land bounded on the West by the West line of said Lot 6; bounded on the South by the Northerly line of the above described parcel 12A, and bounded on the Northeast by a curve concave Northeasterly, having a radius of 25.00 feet and tangent to said West and South boundaries. -2- PARCEL 13: Lot 27 and the East 10 feet of Lot 25 of the Park Tract Addition to Santa Ana, in the City of Santa Ana, County of Orange, State of California, as per map thereof recorded in Book 1, Page 30, of Record of Surveys, in the office of the County Recorder of said Orange County. PARCEL 14: A spandrel shaped parcel of land bounded on the North by the North line of Lot 12 in Block P of the Heil Tract, in the City of Santa Ana, as shown on a map thereof re- corded in Book 23, Page 28 of Miscellaneous Records of Los Angeles County, california; bounded on the West by the West line of said Lot 12; and bounded Southeasterly by a curve concave Southeasterly, having a radius of 25.00 feet and tangent to said North and West boundaries. PARCEL 15: A spandrel shaped parcel of land bounded on the North by a line ~arallel with and 30.00 feet Southerly, measured at right angles, from the center line of First Street; bounded on the West by a line parallel with and 25.00 feet Easterly, measured at right angles, from the center line of Ross Street; and bounded Southeasterly by a curve concave Southeasterly, having a radius of 15.00 feet and tangent to said North and West boundaries. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the property herein ordered to be acquired, upon compliance with the requirements of law applicable thereto, as rights of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That the city of Santa Ana, a municipal corporation, authorized and empowered to provide for the opening, extension, widening, construction, and maintenance of public streets and highways within the City of Santa Ana; and is 5. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
