STATE AID UNDER THE EMERGENCY FLOOD RELIEF LAW
SECTIONS 54150 54164 OF THE GOVERNMENT CODE
WHEREAS, the Emergency Flood Relief Law, Sections 54150,
et seq. of the Government Code, authorizes State aid to repair
or restore storm and flood damage or destruction to public real
property having a general public and state interest, subject to
the appropriation of the necessary funds by the State Legislature;
and
WHEREAS, during the period from February 26, 1969 to
March 1, 1969 there occurred storm and flood damage or destruction
estimated at $301,000.00 to public real property having a general
public and State interest, hereinafter described, lying within the
boundaries of the city of Santa Ana;
NOW, THEREFORE, BE IT RESOLVED that application is hereby
made to the State of california for state assistance under said
law to repair and restore the public real property described in
Exhibit "A" attached hereto and by this referenced made a part
hereof.
BE IT FURTHER RESOLVED that in consideration of the appli-
cation, the city of Santa Ana agrees to indemnify, defend and
save harmless the State, its officers, agents and employees from
any and all claims and losses accruing or resulting by reason of
or in connection with said work, the application for state
assistance or action of any type taken with regard to the same,
including but not limited to claims based upon tort and claims
based upon contract.
BE IT FURTHER RESOLVED that Carl J. Thornton, city Manager,
is designated as the applicant's duly authorized representative
in all matters arising under this application, exclusive of the
power to execute, on behalf of applicant, the agreement with the
appropriate State Department for the performance of the work.
PASSED AND ADOPTED by the city Council of the city of Santa
Ana at its regular meeting held on the 3rd day of August, 1970.
