HomeMy WebLinkAbout70-076P~ESOLUTION 70-76 UPHOLDING THE DECISION OF THE ZONING ADMINISTRATORAND GRANTING A VARIANCE ON VARIANCE APPLICATION 70-31 FILED BY SANTA ANA RECAP AND BRAKE SERVICE, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Zoning Administrator granted a variance on Variance Application 70-31, filed by SANTA ANA RECAP & BRAKE SERVICE to permit storage in the open (enclosed by a solid wall) in the C 2 District at 1810 West First Street, Santa Ana, California; and WHEREAS, Appeal Application No. 241 was duly filed by the SANTA ANA PLANNING COMMISSION, appea~ing the decision of the Zoning Administrator to grant said Variance and presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice has determined that said Variance Application meets the requirements of Section 41-638 of the Santa Ana Municipal Code and that said Variance should be granted subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Zoning Administrator and does hereby grant a variance on Variance Applica- tion 70-31, filed by SANTA ANA RECAP & BP~AKE SERVICE to permit storage in the open (enclosed by a solid wall) in the C 2 District at 1810 West First Street, Santa Ana; and said Variance is granted subject to the following conditions: 1. That the plot plan be modified to show the proposed 6' high block wall extended to the westerly property line; e That the development be according to the approved plot plan except for minor modifications to be approved by the Planning Department; That in the future all tire storage shall be in the southwesterly corner of the property and shall be at least 20 feet away from the building; 4. That no storage extend above the block wall which encloses it. 5. That any outdoor portable signs either be removed or placed inside of the building; THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH AS CONDITIONS OF APPROVAL: 6. Provide a deed for vehicular access rights to First Street except the east 36 feet of the westerly 58 feet. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least four weeks prior to application for a building permit to avoid delay. 7. Payment be made for ornamental street lighting. -1- NOTE: NOTE: Provide on-site underground utility connections per Section 8-837 of the Municipal Code. It is suggested that the owner investigate regular fees for ornamental street lighting, building permits, etc. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 17th day of August, 1970.
