HomeMy WebLinkAbout70-082RESOLUTION 70-82 APPROVING MAP AND DECLARING INTENTION TO VACATE PORTIONS OF HUBBARD STREET, REGENT STREET, AND WARREN STREET: RESERVING AN EASEMENT THEREIN FOR WATER MAIN PURPOSES, AND GIVING NOTICE OF HEARING THEREON W~EREAS, Hubbard Street, between Warren Street and the north boundary of the Hubbard Tract; Regent Street, between Lyon Street and Grand Avenue; and Warren Street, between Hubbard Street and Lyon Street are no longer necessary for present or prospective street purposes, and the Department of Public Works and the Planning Commission of the City of Santa Ana have recommended that a public hearing be set on the question of vacating said rights of way; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of the rights of way proposed to be vacated; BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate those~portion~7of Hubbar~ Street, Regent Street, and Warren Street between Grand Avenue and Lyon Street, and reserve therein an easement for water main purposes. Said rights of way proposed to be vacated lie in the City of Santa Ana, County of Orange, State of California, and are described as: PARCEL 1: REGENT STREET, 60.00 feet wide, as shown on a map of the Hubbard Tract in the City of Santa Ana, as per map recorded in Book 24, Page 22 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, bounded Easterly by a line parallel with and distant 30.00 feet westerly, measured at right angles, with the monumented center line of Lyon Street as established on October 3, 1955 by Ordinance NS 135 of the City of Santa Ana, and bounded westerly by a line parallel with and distant 60.00 feet easterly, measured at right angles, from the center line of Grand Avenue (formerly McClay Street) as shown on a map filed in Book 12, Page 46 of Records of Survey in the office of the County Recorder of Orange County, California. PARCEL 2: That portion of WARREN STREET, 66.00 feet wide, as shown on a map of the Hubbard Tract in the City of Santa Ana, as per map recorded in Book 24, Page 22 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California bounded Westerly by a line parallel with and distant 60.00 feet easterly,measured at right angles, from the center line of Grand Avenue (formerly McClay Street) as shown on a map filed in Book 12, Page 46 of Records of Survey in the office of the County Recorder of Orange County, California and bounded easterly by the Northerly prolongation of the West line of the East 107.58 feet of Lot 2 of the Smith and Maley Subdivision of the McClay Tract, in the City of Santa Ana, as per map recorded in Book 22, Page 96 of Miscellaneous Records, in the office of the County Recorder of said Los Angeles County. RESERVING for the City of Santa Ana an easement for a potable water main over said 66.00 feet of that portion of Warren Street. PARCEL 3: The Northerly 3.00 feet of WARREN STREET, 66.00 feet wide, as shown on a map of the Hubbard Tract, in the City of Santa Ana, as per map recorded in Book 24, Page 22 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California bounded easterly by a line parallel with and distant 30.00 feet westerly, measured at right angles, from the monumented center line of Lyon Street as established on October 3, 1955 by Ordinance NS 135 of the City of Santa Ana, and bounded westerly by the northerly prolongation of the west line of the east 107.58 feet of Lot 2 of the Smith and Maley Subdivision of the McClay Tract, in the City of Santa Ana, as per map recorded in Book 22, Page 96 of Miscellaneous Records in the office of the County Recorder of said LOs Angeles County. PARCEL 4: HUBBAR~ STREET (formerly Park Street), 50.00 feet wide, as shown on a map of the Hubbard Tract in the City of Santa Ana, as per map recorded in Book 24, Page 22 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, bounded northerly by the easterly prolongation of the north line of Block A in said Hubbard Tract, and bounded Southerly by a line p~rallel with and distant 33.00 feet northerly, measured at right angles, from the center line of Warren Street as said Warren Street is shown on a mapof said Hubbard Tract. EXCEPTING that portion of said Hubbard Street lying in Regent Street, 60.00 feet wide, as shown on said map of the Hubbard Tract. BE IT FURTHER RESOLVED: That October 5, 1970, at the hour of 7:30 P.M. in the Council Chambers, City Hall Annex, 500 West Sixth Street, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation; BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said streets, stating the passage of this Resolution of Intention to vacate and the time and place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of hearing.
