HomeMy WebLinkAbout71-030RESOLUTION 71-30 APPROVING MAP AND DECLARING INTENTION TO VACATE APRICOT STREET, EAST OF HALLADAY STP~EET, AND GIVING NOTICE OF HEARING THEREON WHEREAS, Apricot Street, as it exists east of Halladay Street, is no longer necessary for present or prospective street purposes, and the Department of Public Works and the Planning Commission of the City of Santa Ana have recommended that a public hearing be set on the question of vacating said right of way; NOW, TP~REFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of the right of way proposed to be vacated; BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate A~ricgt Street, east of Halladay Street; said right of way proposed to be vacated lies within the City of Santa Ana, County of Orange, State of California, and is described as: Ail that certain land situated in the County of Orange, State of California, described as follows: That portion of the Northerly half of Apricot Street, 60.00 feet wide, as shown on a map of W. G. Benedict's Subdivision of Daniel Halladay Tract recorded in Book 25, pages 7 and 8 of Miscellaneous Records of Los Angeles County, lying between the Southerly prolongation of the Westerly line of Lot 8, Block C and the Southerly prolongation of the Easterly line of Lot 9, Block C, both of said W. G. Benedict's Subdivision. That portion of the Southerly half of Apricot Street, 60.00 feet wide, as shown on a map of W. G. Benedict's Subdivision of Daniel Halladay Tract recorded in Book 25, pages 7 and 8 of Miscellaneous Records of Los Angeles County, lying between the Northerly prolongation of the westerly line of Lot 7, Block D and the Northerly prolongation of the Easterly line of Lot 6, Block D, both of said W. G. Benedict's Subdivision. BE IT FURTHER RESOLVED: That May 3rd, 1971, at the hour of 7:30 P.M. in the Council Chambers, City Hall Annex, 500 West Sixth Street, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interestes in or objecting to said proposed street vacation; BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said street, stating the passage of this Resolution of Intention to vacate and the time and place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of hearing. -1- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 5th day of April, 1971.
