ZONING ADMINISTRATOR AND GRANTING A VARIANCE
ON VARIANCE APPLICATION 71-24 SUBJECT TO
CONDITIONS OF APPROVAL CONTAINED IN FINDING OF FACT
WHEREAS, after public hearing, on notice, the Zoning
Administrator DENIED a variance on Variance Application 71-24
filed by WILLIAM H. BEBERMEYER to construct a duplex in the
C-1 District at 1720 West Santa Ana Boulevard; and
WHEREAS, Appeal Application 270 was duly filed by the
applicant, appealing the decision of the Zoning Administrator
and presenting the matter to the City Coucil; and
W}{EREAS, the City Council, after public hearing, on notice,
has determined that said Variance should be granted, subject
to certain applicable conditions;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby overrules the decision of the
Zoning Administrator and does hereby grant a variance on Variance
Application 71-24 filed by WILLIAM H. BEBERMEYER to permit the
construction of a duplex in the C-1 District at 1720 West
Santa Ana Boulevard, Santa Ana, California; said Variance is
granted subject to the following conditions:
a. Planning Department Requirements 1 and 2;
b. Public Works Requirements 1, 5, 7, 10, 16, 22c, 22d, 41,
42 and 43;
as set forth in Exhibit A attached hereto and made a part
hereof as though set forth in full.
Dedication
Santa Ana Boulevard: 1. Street easement for a width of 52 feet
from center line ~o property line;
2. Vehicular access r~ghts except at the
east 17 feet of this property frontage.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 7th day of June, 1971.

That developmcnt be according to the approved plot plan,
except for miuor modifications approved by the Planniug
Department. ·
That all conditions of the Building and Fire Departments
be met.
That a landscape plan be submitted to and approved by the
Planning Department, including the provisions of Sec. 41-618
of the Zoning Ordinance, and that said landscaping be
implemented and be continuously maintained.
That any trash a~eas be enclosed in accordance with the
Planning Department standards.
That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
That there be no after-hours operation (between 2:00 A.M.
and 6:00 A.M.).
That the business remain a bona fide eating establishment
as defined by the Alcoholic Beverage Control.
That there be no gaming devices, such as pool tables,
~iruball machines, motion picture booths, etc.
That interior lighting of the establishment be in accordance
w~th A.B.c..regulations.
That there be no conduct or entertainment allowed on the
premises as prohibited by Ordinance NS-1047.
That'the use be approved for a period not exceeding six
(6) months, at which time staff will report to the Planning
Commission for revocation of the conditional use permit
should any of the conditions be in violation.

Submit to the Department of Public Works, for..their approval,
an acceptable final grading plan or an ~n-site drainage plan
or both, showing the direction and means of flow to the
adjacent street(s) or channel(s) when this property is

the Department of Public Works for extent of study needs.
