OF THE ZONING ADMINISTRATOR AND GRANTING
A VARIANCE ON VARIANCE APPLICATION 71-23
SUBJECT TO CONDITIONS OF APPROVAL CONTAINED
IN THE FINDING OF FACT
ASSISTANT
WHEREAS, after public hearing, on notice, the Zoning
Administrator DENIED a variance on Variance Application 71-23
filed by JESUS GUILLERMO GARCIA to construct a duplex on a
lot with an existing single family dwelling and a duplex in the R-1
District at 821 - 823 North English Street, Santa Aha, California;
and
WHEREAS, Appeal Application 269 was duly filed by the
applicant appealing the decision of the Zoning Administrator and
presenting the matter to the City Council; and
WHEREAS, the City Council, after public hearing, on
notice, has determined that said variance should be granted,
to certain applicable conditions;

NOW, THEREFORE, BE IT RESOLVED: That the City
Council of the City of Santa Ana hereby overrules the decision of
the Zoning Administrator and does hereby grant a variance on
Variance Application 71-23, filed by JESUS GUILLERMO GARCIA
to permit the construction of one additional dwelling unit on a lot
with an existing single family dwelling and a duplex in the R-1
Distruct at 8Z1-823 North English Street, Santa Aha, California;
said Variance is granted subject to the following conditions:
Planning Department Requirements Z and 5;
b. Public Works requirements 10 and 16;
as set forth in Exhibit A attached hereto and made a part hereof
as though set forth in full;
The following conditions are also attached to said approval:
That a revised plot plan be submitted to and approved by
the Planning Department and that development be according
to the approved revised plot plan except for minor
modifications to be approved by the Planning Department;
That only one (1) additional dwelling unit be shown on the
revised plot plan.
That there be a total of 6 off-street parking spaces, at
least 4 covered and g open spaces; and
That there be a rear yard of at least 20 feet.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 7th day of June
1971.

That devclopment be according to the apDr0ved pl'ot plan,
except for minor modifications app~o~v~ed by the Planning
Department.
That all conditions of the Building and Fire Departments
be met.
That a landscape plan be submitted to and approved ~y the
Planning Department, including the provisions of Sec. 41-618
of the Zoning Ordinance, and that said landscaping be
implemented and be continuously maintained.
That any trash ameas ~e enclosed in accordance with the
Planning Department standards.
That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
That there be no after-hours operation (between 2:00 A.M.
and 6:00 AoM.).
That the business remain a bona fide eating establishment
as defined by the Alcoholic Beverage Control.
That there be no gaming devices, such as pool tables,
~inball machines, motion picture booths, etc.
That interior lighting of the establishment ~e in accordance
w~th A.B.C. regulations.
That there be no conduct or entertainment allowed on the
premises as prohibited by Ordinance NS-1047.
That'the use ~e approved for a period not exceeding six
(6) months, at which time staff will report to the Planning
Commission for revocation of the conditional use permit
should any of the conditions be in violation.

Submit to the Depnrt;nent of Public Works, for..thoir approval,
an acceptable final grading plan or an ~n-site drainage plan
or both, showing the direction and means of flow to tile

on a storm of a ten-year* frequency to show existing and
proposed facilities and methods of draining this site and
tributary areas without exceeding the capacity of any street,
on-site or off-site.

Submit an on-site water system study and plan to the Depart-
ment of Public Works.
Dedicate required street or alley right of way.
Provid~ a ten-year continuing offer of dedication for recruited
street right of way.
Dedicate vehicular access rights.

General Notes

be prepared under the direction of a registered Civil

Ail public improvement construction 'shall be subject to

Ail elev,ntions shall be referenced to the 1958 Orange
County Survey Datum.
Required property dedications shall be initiated by the
owner, ~through the Department of Publi, Works, at least
four weeks prxor to application for a building permit,
or use as applicable, to avoid delay.
In certain cases, the City will reimburse owner for eligible
street improvements costs. Owner is advised to contact
the Department of Public Works for information regarding
this reim!~ursement policy.
No additional openings in existing median island will be
allowed except as approved on the plot plan.
