AND GRANTING A VARIANCE ON VARIANCE APPLICATION
71-22, SUBJECT TO APPLICABLE COIqDITIONS
W~EREAS, after public hearing on notice, the Zoning
Administrator granted a variance on Variance Application 71-22
filed by HAROLD GRIFFIN to utilize an existing building in the
R-2 District at 3501 West First Street, Santa Ana, California;
and
W~EREAS, Appeal Application 271 was duly filed by the
applicant, appealing the decision of the Zoning Administrator
to require the dedication of 2 1/2 feet of the property adjacent
to an unpaved alley and to require the paving of oneLhalf of the
alley, and presenting the matter to the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that said Variance should be granted, subject to
certain applicable conditions;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby approves the decision of the Zoning
Administrator and does hereby grant a variance on Variance
Application 71-22 filed by HAROLD GRIFFIN to permit the utilization
of an existing building in the R-2-biSt~ct at 114 North Gunther
Street, Santa Ana, California; said variance is granted subject
to the following conditions:
a. Planning Department requirements 1 and 2;
b. Public Works requirements 8a, 16, 17, 2la, b,
40, 41, 42, and 43
as set forth in Exhibit A attached hereto and made
as though set fo~t~ in full;

Gunther Street: Remove existing asphalt berm and place curb and
gutter. Pave out road way as required. Construct full width
sidewalk with tree wells.
In addition, the following condition is imposed:
Applicant shall provide a surety bond guaranteeing improvement of
one-half the alley at such time as the entire alley is improved.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 7th day of June, 1971.

That devclopmcnt be according to the approved plot plan,
except for minor modifications approved by the Planning
Department. ~ .%?
That all conditions of the Building and Fire Departments
be met.
That a landscape plan be submitted to and approved by the
Planning Department, including the provisions of Sec. 41-618
of the Zoning Ordinance, and that said landscaping be
implemented and be continuously maintained.
That any trash areas ~e enclosed in accordance with the
Planning Department standards.
That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
That there be no after-hours operation (between 2:00 A.M.
and 6:00 A.M.).
That the business remain a bona fide eating establishment
as defined by the Alcoholic Beverage Control.
That there be no gaming devices, such as pool tables,
~in~all machines, motion picture booths, etc.
That interior lighting of the establishment be in accordance
with A.B.C. regulations.
That there be no conduct or entertainment allowed on the
premises as prohibited by Ordinance NS-1047.
That'the use be approved for a period not exceeding six
(6) months, at which time staff will report to the Planning
Commission for revocation of the conditional use permit
should any of the conditions be in violation.

an acceptable final grading plan or an on-site drainage plan

the Department of Public Works for extent of study needs.
2. Submit a sanitary sewer study to the Department of Public Works.
Submit to the Department of Public Works a runoff study based
on a storm of a ten-year* frequency to show existing and
proposed facilities and methods of draining this site and
tributary areas without exceeding the capacity of any street,
on-site or off-site.

4. Submit an on-site water system study and plan to the Depart-
ment of Public Works.

this reiml~ursement policy.

allowed except as approved on the plot plan.
