AND HOWARD BEAR BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby grant Appeal 9290 approving Variance Application No. 71-54 filed by Harold Segerstrom et al. and Howard Bear to construct an 838 unit multiple family apartment project on ap- proximately 33 acres of land in the R 1 District located at 3737 S. Bear Street, Santa Ana, subject to the following conditions: 1. That all conditions of the Building and Fire Departments be met. That a landscape plan be submitted to and approved by the Planning Departmrnt, including the provisions of Sec. 41-618 of the Zoning Ordinance, and that said landscaping be implemented and be continuously main- tained. 3. That any trash areas be enclosed in accordance with the Planning Department standards. 4. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways. The following requirements must also be met: 1. Revised plot plan to show the following: ae No structure or offstreet parking area or access to parking stalls shall be closer to a street right of way than 15 feet. B. Maximum of 50% coverage of land area. Ail offstreet parking and carport openings shall be screened so as not to be seen from any public right of way in a manner meeting the approval of the Plan- ning Department. A link for pedestrian access between the apartments proposed in this application and the shopping center to the south. NOTE: A plan should be submitted to the Planning Department for their approval indicating a meaningful path system that creates a pedestrian linkage between the apartments and the shopping center that affords physical and visual separation from structures. E. The development will be restricted to adults only. F. The right of way of Bear Street is to be increased to 100 feet. 2. The following conditions are to be complied with prior to the issuance of a building permit: File a parcel map with the Planning Department showing the severance of this area, and comply with all Council approved conditions. Submit a revised plot plan to the Departments of Planning and Public Works for their approval show- ing the following changes from the original plot plan. - 1 - Medians: Median openings and configurations for Plaza Drive, Bear Street, and MacArthur Blvd. shall be in accordance with the require- ments of the Public Works Department, as such requirements may be developed jointly between the Department and the applicant. (2) Sidewalks: The dimensions and locations of sidewalks and street trees on Bear Street, Plaza Drive and MacArthur Boulevard shall be in accordance witk the requirements of Public Works Department. (3) Ail driveways to City standards. (4) MacArthur Blvd. between Plaza Drive and Bear Street, show only the central drive. (5) MacArthur Blvd. west of Bear Street show right turn movement only. NOTE: There will not be any opening in the future raised median at this location. (6) Plaza Drive, the divided drive to be to City standards with a width of 40 feet. (7) Bear Street, show only two driveways on each side of the street and eliminate the pedestrian crosswalks. (8) Resolve Wakeham Avenue in relation to develop- ment of this area. NOTE: If Wakeham Avenue is abandoned, the City should retain a utility easement from center line to 25 feet north. Furnish to the Department of Public Works for their ap- proval the following: (i) A sewer study showing the proposed sewer facilities through this entire area (Sanitation District No. 7 approval required). (2) A runoff study by a civil engineer based on a storm of a ten year frequency. Show existing and proposed facilities and methods of draining this area and tributary areas without exceeding the capacity of any street, on-site or off-site. Pad elevations to be one foot above the center line of Sunflower Avenue. (3) A final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets when this property is developed. Plan is to include existing and proposed eleva- tions at the property lines. D. Provide street easements for: (1) Bear Street for a width of 50 feet from center line to property line, or as required by Depart- ment of Public Works. Fe (2) MacArthur Blvd. for a width of 52 feet from center line to property line. (3) Spandrels with a 25 foot radius at the southeast and southwest corners of MacArthur Blvd. and Bear Street. Provide vehicular access rights to Bear Street and Mac- Arthur Blvd. except at the street intersections and approved driveway openings. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least four weeks prior to application for a building permit to avoid delay. NOTE: Curbside parking will not be allowed on Bear Street, MacArthur Blvd. or Plaza Drive. Submit street improvement plans by a civil engineer for Bear Street, and MacArthur Blvd. (See City Plans 1-73-1, 23-59 and 18-58). (All elevations to be on 1958 Orange County Survey Datum). Also plan 47-12 for Plaza Drive. Ail plans and surveys for the required improvements shall be completed by the engineer and submitted to the Department of Public Works for approval. Install approved ornamental street lights (with underground connections) along all street frontage in accordance with approved system (or pay deposit as required by Public Works Department). The following conditions are to be complied with prior to issuance of utilities release by the Department of Building Safety and Housing: Provide sanitary sewer facilities as required by the Department of Public Works and Department of Building Safety and Housing. B. Provide storm drain facilities as required by the approved run-off study. C. Improve Bear Street with pavement, curb and gutter, and full width sidewalk with tree wells and trees. De Improve MacArthur Blvd. gutter, and full width and trees. with pavement, curb and sidewalk with tree wells E. Improve Plaza Drive with pavement, curb and gutter and full width sidewalk with tree wells and trees. F. Comply with all applicable Council approved condi- tions for Parcel Maps 704 and 705. Required Fees: 1. Drainage assessment 2. Sanitation District 7 3. Water main and service connection charges. J?
