GRANTING APPEAL #295 AND APPROVING
VARIANCE APPLICATION 72-15 FILED BY
CHARLES B. LINGER
BE IT RESOLVED: That, based upon the Findings of
Fact of the Planning Commission, the City Council of the
City of Santa Ana does hereby overrule the decision of
the Planning Commission, and Appeal #295 on Variance
Application 72-15 filed by Charles B. Linger to allow
expansion of non-conforming commercial use with less
than required parking at 326-28, 30 W. 17th Street
(C 1 HD II District) is hereby granted, subject to the
following conditions:
1. That all conditions of the Building and Fire
Departments be met.
2. That any trash areas be enclosed in accordance
with the Planning Department standards.
3. Pay street lighting deposit for future street
lights.
The following requirements must also be met:
Applicant submit fully dimensioned plot plan and
elevations in a manner meeting the approval of
the Planning Department.
Remove the existing off-premise signs (2 billboards).
No off-premise sign shall be relocated on the
property and no new off-premise sign shall be
constructed on the property.
3. Ail on-premise signs shall conform to the Sign
Ordinance.
4. The premises will be limited to two uses.

The council action varies the strict application of
the parking requirements and standards of the code
as they apply to this site and the applicant will
be permitted to continue the parking use as it
presently exists.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 1st day of
