HomeMy WebLinkAbout72-067RESOLUTION NO. 72-67 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DENYING ~.PPEAL #296 FILED BY SANDPOINTE HOMEOWNERS' ASSOCIATION AND UP- HOLDING THE DECISION OF THE PLANNING COM- MISSION GRANTING VARIANCE APPLICATION 72-10 FILED BY ROBERT H. GRANT CORPORATION BE IT RESOLVED: That, based upon the Findings of Fact of the Planning Commission presented before the City Council, the City Council of the City of Santa Ana hereby denies Appeal #296 filed by Sandpointe Homeowners' Association and upholds the decision of the Planning commission granting VA 72-10 filed by Robert H. Grant Corporation to allow a small commercial development facing MacArthur Blvd. and 42 town house units facing Main Street in the C 4 District, subject to the following conditions: That development be according to the approved plot plan, revised as follows, except for minor modifications approved by the Planning Department. 1 (a)The plot plan shall be revised to provide for the following numbered bedroom units: 10 - 2 bedroom units with 914 square feet. COrdinance requires 800 square feet~ 20 - 2 bedroom units with 984 square feet. (Ordinance required 800 square feet~. 10 3 bedroom units with 1,453 square feet. (Ordinance required 900 square feet). 2 - 2 bedroom units with 800 square feet. (Ordinance requires 800 square feet)· l(b) There shall be 126 offstreet parking spaces of which 42 are covered and 84 are open. (Ordinance required a total of 63). That all conditions of the Building and Fire Departments be met. e That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance, and that said landscaping be implemented and be continuously maintained. That any trash areas be enclosed in accordance with the Planning Department standards. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways. Submit to the Department of Public Works, for their approval, an acceptable final grading plan or an on-site drainage plan or both, showing the direction and means of flow to the adjacent street(s] or channel(s) when this property is developed. Plan is to include existing and proposed eleva- tions at the property lines. Applicants should check with the Department of Public Works for extent of study needs. e Submit a sanitary sewer study to the Department of Public Works. 8. Dedicate vehicular access rights. Provide construction plans for: a. required street improvement, b. sewer system 10. 11. 13. 14. Pay City sanitary sewer main assessment fee. Pay Sanitation District No. 7 fee. Pay water service connection charges. Pay street tree charges. Comply with applicable conditions of previously approved tract map or parcel map pertaining to this site. 15. Construct necessary street improvements; 16. 17. 18. 19. 20. a. sidewalk, b. driveway, c. tree wells. Construct necessary sewer facilities as required by the Department of Public Works. Provide for installation of approved street lighting with underground service on all street frontages unless other- wise noted. Ail plans and surveys for required public improvements shall be prepared under the direction of a registered Civil Engi- neer and shall be submitted to the Department of Public Works for approval. Ail public improvement construction shall be subject to inspection and approval by the Department of Public Works. Ail elevations shall be referenced to the 1958 Orange County Survey Datum. 21. No additional openings in existing median island will be allowed except as approved on the plot plan. 22. One window only per unit to be located in the kitchen will be permitted in the second floor units which face South or West toward signle family residences. The following requirements must also be met: ae A minimum of 50% open space shall be maintained in the apartment complex. Be A minimum of a 45' setback between two story units in the apartment complex and the single family property lines to the south and west shall be maintained. Ce The 5' pedestrian access from the apartment complex to MacArthur Blvd. running along the west edge of the commercial lot is to be tied to the apartment complex either as part of the legal lot or through a perpetual easement. The accessway is to be protected from the commercial parking lot by wheel stops or buffers approved by the Planning Department. 6' masonry walls are to be constructed along the south and west sides of the service station lot (4' in front 20' setbacks}; and the west property line of subject property (existing wall is only 4' from grade adjacent to Sandpointe models area. 4' high wall in front 20' setback along MacArthur). Existing wooden gate along southerly wall (approximately 130' from Main Street) is to be removed and replaced with 6' masonry wall. Ge Ke Oe 6' solid walls screening offstreet parking along Main Street from the street. 6' masonry wall between apart- ment complex and commercial area except at westerly 5'. Two or more trash areas for the apartment complex enclosed to Planning Department standards. The two proposed trash areas on the commercial portion are to be enclosed to Planning Department standards. Parking lot landscaping in commercial portion shall conform to Section 41-618 (Offstreet Parking, Landscap- ing Requirements) of the Santa Aha Municipal Code. Ail offstreet parking areas in the apartment complex not under cover shall be screened from the view of surrounding residents or tenants of the project by shrubs and bushes, the normal growth of which is not less than four (4) feet in height. Construct 5' masonry wall to screen offstreet parking from Main Street. Construct 4' masonry wall between north side of resi- dential area and alley except at approved drives. File a parcel map overlaying existing property split with new lot lines corresponding to proposal and comply with all Council approved conditions. Ail roof top service equipment (such as an air conditioner is to be screened from public view. A water main system capable of delivering a total fire flow of 2,500 gallons per minute from approved hydrants, located not more than 500 feet apart, shall be provided. A 50' outside and 30' inside radius shall be provided at all driveway turns. The recreation building and its use shall comply with the regulations of Title 19, California Administrative Code (Public Safety} and the Uniform Fire Code. Plans shall be submitted to the Fire Department for approval prior to issuance of a building permit: Details of Requirements (1} Dedications (a) MacArthur Blvd. 1. Vehicular access rights except at approved driveways (b) Main Street 1. Vehicular access rights except at approved driveways. NOTE: Ail driveways along Main Street shall be right turn only. There will be a raised median island in Main Street in the future and no median break will be allowed on Main Street for this property. The easterly drive on MacArthur Blvd. shall also be right turn only. The westerly drive on MacArthur Blvd. will be serviced by an existing median break which allows left turns in and out of the sub~ect property. (2) Improvements (a) MacArthur Blvd. - construct full width sidewalk with tree wells and trees, orna- mental street lights, and driveways. Cb) Main Street - construct full width sidewalk with tree wells and trees, ornamental street lights, and driveways.
