HomeMy WebLinkAbout72-080RESOLUTION NO. 72-80 SANTA ANA CITY COUNCIL RESOLUTION NO. 72-80,OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING APPEAL NO. 307 AND APPROV- ING VARIANCE APPLICATION 72-49 FILED BY HOWARD I. PAMPLIN AND LEONARD R. PAMPLIN BE IT RESOLVED: That, based upon the Findings of Fact of the Planning Commission and testimony presented before the City Council, the City Council of the City of Santa Aha hereby reverses the decision of the Planning Commission and grants Appeal No. 307 on Variance Application 72-49 filed by Howard I. and Leonard R. Pamplin to allow offstreet parking on a lot with an existing residence and to waive the required wall at 334 W. 18th Street in the R 2 B District subject to the following conditions: That development be according to the approved plot plan, except for minor modifications approved by the Planning Department. That all conditions of the Building and Fire Departments be met. e That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance, and that said land- scaping be implemented and be continuously maintained. submit to the Department of Public Works, for their appro- val, an acceptable final grading plan or an on-site drain- age plan or both, showing the direction and means of flow to the adjacent street(s) or channel(s) when this property is developed· Plan is to include existing and proposed elevations at the property lines. Applicants should check with the Department of Public Works for extent of study needs· 5. Dedicate required street or alley right of way. 6. Dedicate vehicular access rights. 7. Pay street lighting deposit for future street lights. 8. Pay street tree charges. e Repair or replace existing street improvements to City standards: a. Sidewalk 10. Close existing driveways as required to City Standards. 11. Ail public improvement construction shall be subject to inspection and approval by the Department of Public Works. 12. Required property dedications shall be initiated by the owner, through the Department of Public Works, at least four weeks prior to application for a building permit, or use as applicable, to avoid delay. 13. The following requirements must also be met: A. That a minimum 3' wide landscaped planter and 4' high wall be constructed along 18th Street except at the existing driveway. These shall comply with the requirements of Section 41-611 b (5) i & ii of the Zoning Code. B. That 6' high masonry walls be constructed along the subject property lines of the subject lot where they abut the parking area. C. That no structures of any kind be erected upon the subject property as long as the variance is in effect. D. That all parking spaces on both lots conform to City standards. E. That any other requirements of the B (Parking Modifi- cation District) be complied with. F. The following requirements are also to be complied with prior to the issuance of a building permit: (1) NOTE: There is a wall of an existing City owned building on part of the property where the new addition is proposed. (2) Submit a revised plot plan showing that wall of City owned building may he removed only by the City and dedication of the alley for 10 feet from center line to property line. G. Details of Requirements: Dedications (a) alley 1. For 10 feet from center line to property line. (b) 17th Street 1. Vehicular access rights (2) Improvements (a) 18th Street 1. Replace existing sidewalk and place street tree. (b} 17th Street 1. Close existing drive approach to City standards NOTE: The applicant should investigate standard fees for future ornamental street lights, street trees, etc. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the ?th day of ~, 1972.
