RESOLUTION 73-13
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APPROVING MAP AND DECLARING
INTENTION TO VACATE A PORTION OF POINSETTIA
STREET SOUTH OF PENN WAy, AND GIVING NOTICE
OF HEARING THEREON
WHEREAS, Poinsettia Street as it exists south
of Penn Way is no longer necessary for present or
prospective street purposes, the Department of Public
Works and the Planning Commission of the City of Santa
Ana have recommended that a public hearing be set on
the question of vacating said right of way;
NOW, THEREFORE, BE IT RESOLVED: That the City
Council of the City of Santa Ana hereby approves the
map attached hereto and orders the same filed with the
original of this Resolution in the office of the Clerk
of the Council, and reference is hereby made to said
map for the exterior boundaries of the right of way
proposed to be vacated;
BE IT FURTHER RESOLVED: That the City Council
hereby declares its intention to proceed into the pro-
visions of the Street Vacation Act of 1941 (Sections
8300 - 8374 of the California Streets and Highways
Code) to vacate that portion of Poinsettia Street,
south of Penn Way; said right of way proposed to be
vacated lies within the City of Santa Ana, County of
Orange, State of California, and is described as:
The Southerly 92.30 feet of Poinsettia Street,
a~public right of way 45.00 feet in width, in
the City of Santa Ana, County of Orange, State
of California, being bounded Northerly by the
Westerly prolongation of the Southerly line of
the Northerly 32.50 feet of Lot 13, Block 11 of
"Subdivision of Blocks 10 and 11 in the Town of
Santa Ana~ East" as shown on a map recorded in
Book 24, page 76 of Miscellaneous Records of Los
Angeles County, California, and bounded Southerly
by the Westerly prolongation of the Southerly line
of Lot 15 of said Block 11.
Reserving an easement and right of way to construct,
lay, install, use, maintain, alter, add to, repair,
replace, inspect and/or remove, at any time and from
time to time, aerial and underground electric lines
and communication lines, consisting of poles, guys
and markers and other fixtures and appliances, for
conveying electric energy to he used for light, heat,
power, telephone and/or other relate4 uses, in, on,
over, under and through that certain real property
in the City of Santa Ana, County of Orange, State of
California, described as follows:
The Easterly 10.00 feet thereof.
Also reserving an easement and right of way to
construct, lay, install, use, maintain, alter,
add to, repair, replace, inspect, and/or remove,
at any time and from time to time, surface and
underground drainage structures for drainage
purposes, or other related uses, in, on, over,
under and through that certain real property in
the City of Santa Ana, County of Orange, State
of California, described as follows:
The Westerly 4.00 feet thereof.
BE IT FURTHER RESOLVED: That March 19, 1973, at
the hour of 7:30 p.m. in the Council Chambers, Santa
Ana City Hall, 20 Civic Center Complex, Santa Ana,
California, is hereby fixed as the time and place for
hearing all persons interested in or objecting to said
proposed street vacation;
BE IT FURTHER RESOLVED: That the Clerk of the
Council of the City of Santa Ana is hereby ordered to
publish this Resolution one time in the Register, and
the Director of Public Works is ordered to post notices
of street vacation conspicuously along the line of said
street, stating the passage of this Resolution of Inten-
tion to vacate and the time and place appearing thereon.
Said notices shall be posted not more than three hundred
(300) feet apart and at least three (3) such notices
shall be posted. Both publication and posting shall be
completed at least ten (10) days before the date of
hearing.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 20th
day of February . . , 1973.
