HomeMy WebLinkAbout73-024RESOLUTION NO. 73-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA UPHOLDING THE DECISION OF THE ZONING ADMINISTRATOR AND APPROVING MINOR EXCEPTION NO. 73-3 FILED BY DIETRICH REICH BE IT RESOLVED: That based upon the finding of fact of the Zoning Administrator, the City Council of the City of Santa Ana does hereby grant Minor Exception 73-3 filed by Dietrich Reich to allow a restaurant with on sale liquor within 300' of residentially zoned property subject to the following condi- tions: That development be according to the approved plot plan, except for minor modifications approved by the Planning Department. That all conditions of the Building and Fire Departments be met. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning ordinance, and that said landscaping be imple- mented and be continuously maintained. That the business remain a bona fide eating establishment as defined by the Alcoholic Beverage Control. That there be no gaming devices, such as pool tables, pinball machines, motion picture booths, etc. That interior lighting of the establishment be in accordance with A.B.C. regulations. That there be no conduct or entertainment allowed on the premises as prohibited by Ordinance NS-1047. That the use be approved for a period not exceeding six (6) months, at which time staff will report to the Planning Commission for revocation of the con- ditional use permit should any of the conditions be in violation. 9. Pay City water main charges. 10. Pay water service connection charges. 11. Pay street lighting deposit for future street lights. 12. The applicant should be advised that curbside park- ing on Seventeenth Street and Fairview Street will not be permitted at the subject location at some time in the near future. -1- RESOLUTION NO. 73-24 13. The applicant should investigate standard fees for water main, future street lights, etc. 14. The building and its use shall conform to the regulations of Title 19, California Administrative Code (Public Safety) and the Uniform Fire Code. 15. Plans of the above condition shall be submitted to the Fire Department for approval prior to issuance of a building permit.
