ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 4
WHEREAS, by Minute Order dated March 12, 1973, a public hearing was
called for April 2, 1973, at the hour of 7:30 P.M., at the Council Chambers
of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain
whether the public necessity, health, safety, or welfare requires the re,oval
of poles, overhead wires and associated overhead structures, and the udder-
ground installatic~ of wires and facilities for supplying electric cuL,,,uni-
catio~ or similar or associated service, within that certain area of the City
described as follows for the formatic~ of the Underground Utility District No.
4: That strip of land measuring 70 feet wide frcm the center line to each
side of Seventeenth Street between Ross Street and approximately 191 feet west
of Main Street as shown on attached Exhibit "A"; and
WHEREAS, notice of such hearing has been given to all affected property
owners as such ere shown on the last equalized assessment roll and to all
utilities concerned in the manner and within the time re~ red by law; and
WHEREAS, such hearing has been duly add regularly held, and all persons
interested have been given an opportunity to he heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa
Aha: That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the
above-described area is hereby declared an Underground Utility District, and
is designated as Underground Utility District No. 4 of the City of Santa Ana.
Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this
Resolution, is amp delineating the boundaries of said District;
BE IT FD~'HER RESOLVED: That the City Council does hereby fix April 15,
1974, as the date on which affected property owners mst he ready to receive
underground service, and does hereby order the r~moval of all poles, overhead
wires and associated overhead structures and the underground installation of
wires and facilities for supplying electric, cu~,,L~nication, or similar or assoc-
iated service within Underground Utility District No. 4 on or before June 1, 1974.
BE IT FURTHER RESOLVED: That the Clerk of the Council is hereby instruct-
ed to notify all affected utilities add all persons owning real property within
U~derground Utility District No. 4 of the adoption of this Resolution within ten
(10) days after the date of such adoption. Said Clerk of the Council shall
further notify said property owners of the necessity that, if they or any person
occupying such property desire to continue to receive electric, ccm~mication or
other similar or associated service, they or such occupant shall, by the date
fixed in this Resolution, provide all necessary facility changes on their premises
so as to receive such service frcm the lines of the supplying utility or utilities
at a new location, subject to applicable rules, regulations and tariffs of the
respective utility or utilities on file with the Public Utilities Cu~,~ssion of
the State of California. Such notification shell he made by mailing a copy of
this Resolution, together with a copy of said Santa Ana Municipal Code Sections
37-1 to 37-13 to all affected property owners as such ere shown on the last
equalized asses~_nt roll and to the affected utilities;
BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana
hereby fiDds and determines as follows:
The Underground Utility District herein created is in the general public
interest for the following reason: The undergrounding to he accc~plished will
avoid or eliminate an unus,~lly heavy concentration of overhead distribution
facilities.

its regular meeting held on the 2nd day of April, 1973.
