A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA UPHOLDING THE DECISION OF THE PLANNING
COMMISSION OF THE CITY OF SANTA ANA AND APPROVING
VARIANCE NO. 73-6 FILED BY H AND J MABURY COMPANY
BE IT RESOLVED: That based upon the findings of fact
of the Planning Commission of the City of Santa Ana, the
City Council of the City of Santa Ana does hereby grant
Variance 73-6 filed by H and J Mabury Company to construct
a 290 unit garden complex at 1350 North Cabrillo Park Drive
in the R-4 and R-1 district subject to the following condi-
tions:
1. That the following standard conditions of approval
must be met:
A. Planning:
1. That all conditions of the Building Department be met.
That a landscape plan be submitted to and approved by
the Planning Department, including the provisions of
Sec. 41-618 of the Zoning Ordinance (prior to issuance
of a building permit) and that said landscaping be
implemented (prior to utility release) and be contin-
uously maintained.
3. That any trash areas be enclosed in accordance with
the Planning Department standards.
4. That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
That an Environmental Impact Report be prepared, sub-
mitted and approved by all departments, commissions,
boards and/or agencies prior to the issuance of
building permits.
That a screening plan for mechanical equipment or
appurtenances be submitted to and approved by the
Planning Department.
7. That all conditions of the Fire Department be met.
B. PUBLIC WORKS
Submit to the Department of Public Works, for their
approval, an acceptable final grading plan or an on-site
drainage plan, or both, showing the direction and means
of flow to the adjacent street(s) or channel(s) when
this property is developed. Plan is to include existing
and proposed elevations at the property lines. Appli-
cants should check with the Department of Public Works
for extent of study needs.
2. Dedicate required street or alley right of way.

3. Dedicate vehicular access rights.
4. Provide construction plans for:
a. required street improvement,
b. water system
5. Pay drainage assessment fee.
6. Pay City sanitary sewer main assessment fee.
7. Pay Sanitation District No. 7 fee.
8. Pay City water main charges.
9. Pay water service connection charges.
10. Pay street lighting deposit for future street lights.
11. Pay street tree charges.
Prior to Utilities Release

Comply with applicable conditions of previously
approved tract map or parcel map pertaining to this
site.
13. Construct necessary street improvements:
a. paving,
b. curb and gutter,
c. sidewalk,
d. driveway
e. cross-gutter,
f. tree wells.
14. Construct necessary sewer facilities as required by
the Department of Public Works.
15. Construct necessary water system facilities as
required by the Department of Public Works.
16. Dedicate water system to the City.
17.
Provide for installation of approved street lighting
with underground service on all street frontages unless
otherwise noted.
18.
Ail plans and surveys for required public improvements
shall be prepared under the direction of a registered
Civil Engineer and shall be submitted to the Depart-
ment of Public Works for approval.
19.
Ail public improvement construction shall be subject
to inspection and approval by the Department of
Public Works.
20. Ail elevations shall be referenced to the 1958 Orange
County Survey Datum.

21. Required property dedications shall be initiated by
the owner, through the Department of Public Works, at
least four weeks prior to application for a building
permit, or use as applicable, to avoid delay.
22. No additional openings in existing median island
will be allowed except as approved on the plot plan.
The following requirements must also be met:
A. Development be according to the approved revised plot
plan.

Development conform to all provisions of the R 4
District, including site plan review procedure,
except for the waiver of the setbacks if provided for
by the conditions of this variance.
C. Record PM 785 prior to the issuance of building permits.

Provide a 30 foot landscape strip between offstreet
parking and Mabury Street in the R 1 zoned land. Land-
scape plans, plot plans and elevations of carports to
be approved by the Planning Department when submitted
by the applicant. The 30' landscape strip to contain
berms and dense landscaping. Height and design of
berm and landscaping shall meet with the approval of
the Planning Department.
E. Development maintain a maximum of 51% land coverage.
F. Unit size to meet R 4 Ordinance requirements.

A 6' high concrete block wall be constructed adjacent
to the City Park on Mabury Street. Block wall behind
parking in the R 1 area shall be subject to the approval
of the Planning Department and shall be 6' high outside
of wall.
A concrete block wall approximately 4' in height or
similar screening device shall be constructed between
the parking lot on Cabrillo Park Drive and the street.
Said screening device to be located subject to Planning
Department approval.
I. Bumper stops be provided in all parking areas.
J. Location and design of master TV antennas shall meet
with the approval of the Planning Department.

Block wall or similar screening device on 15th Street
minimum 4' in height along all open parking except at
enclosed carports. All carports to be enclosed with
a concrete block wall along 15th Street.
Elevations and design for the building located in the
R 1 zone shall be required subject to the approval of
the Planning Dept.
The following requirements of the Department of Public Works
and Fire Department must be met:

A. The following requirements are also to be complied
with prior to the issuance of a building permit:
Comply with all Council approved conditions for
PM 785.
B. Dedications
1)
Cabrillo Park Drive: Vehicular access rights
except at driveway locations as shown on the
approved plan.
2)
Fifteenth St.: Street easement for a width of
30 feet from center line to property line to-
gether with a 15-foot radius spandrel at the
southeast corner of Fifteenth Street and Mabury
Street and a 25-foot radius spandrel at the
southwest corner of Fifteenth Street and Cabrillo
Park Drive.
3)
Mabury Street: Street easement for a width of 30
feet from center line to property line.
C. Improvement Plans
1) Fifteenth Street
2) Mabury Street
D. Improvements
1)
Cabrillo Park Drive: Drive approaches to be to
City standards.
2)
Fifteenth Street: Pavement to the center line,
curb and gutter at 22 feet south of the center
line, and full width sidewalk.
3)
Mabury Street: Pavement to meet existing pavement,
curb and gutter at 20 feet east of the center line
and full width sidewalk.
NOTE:
Developer to install water system in Fifteenth Street at
his sole expense and dedicate said system to the City
of Santa Ana.
The applicant should be advised that curb side parking on
Cabrillo Park Drive will not be permitted at the subject
location.
FIRE DEPARTMENT
2A rated fire extinguishers shall be located on each story
and within 100 feet of travel distance from any area of
each building.
A water main system capable of delivering 2,000 gallons
per minute from approved hydrants located not more than
500 feet apart, shall be provided. Hydrants shall be
installed to conform to City Improvement Standard #403 and
painted chrome yellow. This system shall be placed in
service prior to the commencing of any combustible
construction.

Emergency access driveways of at least 20 feet in width
with a vertical clearance of 13 feet shall be provided
to within 150 feet of all portions of the buildings and
paved the total width to adequately support 30,000
pounds of fire apparatus. A 50 foot outside and 30
foot inside unobstructed turn radius shall be provided
wherever the driveways make a turn.
Plans of the above three conditions shall be submitted
to the Fire Department for approval prior to issuance
of a building permit.
BE IT FURTHER RESOLVED: That the Environmental Impact Report
prepared and adopted by the Santa Ana Planning Commission and
all oral and real evidence received at the Public hearing on
this appeal, are hereby adopted as the final Environmental
Impact Report of the City Council for Variance No. 73-6.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its adjourned regular meeting held on the
25 day of June , 1973.
