A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA DECLARING THAT AN URGENT NECESSITY RE-
QUIRES THAT CONTRACTS FOR THE PURCHASE OF GASOLINE
FOR THE FISCAL YEAR BEGINNING JULY 1, 1973 BE LET
WITHOUT ADVERTISING FOR BIDS AND AUTHORIZING THE
CITY MANAGER TO EXECUTE SUCH CONTRACTS ON BEHALF
OF THE CITY
WHEREAS, the City of Santa Ana by contract is currently
supplied with gasoline for city Fire Department vehicles by
the Standard Oil Company of California and for all other
vehicles including police vehicles by the Shell Oil Company,
and
WHEREAS, in anticipation of the expiration of these
contracts on June 30, 1973 the City advertised in May of
1973 for competitive bids for gasoline contracts for the
year beginning July 1, 1973 as required by Section 421 of
the City Charter, and
WHEREAS, no bids whatsoever were offered for Fiscal
Year 1974 and the City has been informed by potential suppliers
that no bids will be made in view of the general national in-
dustry-wide shortage of gasoline and other fuels, and
WHEREAS, the Federal Government is expected to require
suppliers of gasoline to governmental agencies in Fiscal
Year 1973 to offer to supply such agencies with at least
equivalent amounts of fuel for Fiscal Year 1974, and
WHEREAS, the Standard Oil Company of California has
offered to contract with the City to supply up to 26,000
gallons of premium gasoline for the year beginning July 1,
1973 at a fair bulk market price for use by the Fire Depart-
ment and the Shell Oil Company has offered to contract with
the City to supply up to 300,000 gallons of premium gasoline
and up to 100,000 gallons of regular gasoline at a fair bulk
market price for use by other city agencies, and
WHEREAS, the City Council has been advised by the City
Manager and agrees that these contract offers are the only
available sources for guaranteed fuel delivery for Fiscal
Year 1974 in view of the current and anticipated general fuel
shortage, that no other potential suppliers will offer to
supply the City's requirements and that under the circumstances
of the national fuel shortage the terms and conditions of the
offered contracts are reasonable and the best that can be
obtained, and
WHEREAS, the life, health and property of the citizens of
Santa Ana will be seriously endangered if the Fire Department,
Police Department and other city departments and agencies are
not guaranteed a continuing supply of fuel from and after
July 1, 1973 to operate fire and police vehicles and other
vehicles and equipment,
NOW, THEREFORE BE IT RESOLVED, that the City Council of
the City of Santa Ana finds and declares that it is impossible
under the circumstances of the current and anticipated

future general shortage of fuel to arrange for a guaranteed
supply of the City's needs for gasoline for Fiscal Year 1974
under the normal competitive bidding procedure since no bids
have been received in response to the City's properly
advertised invitation for bids and further finds and declares
that it is of urgent necessity for the preservation of the
lives, health and property of the citizens of Santa Ana that
the City enter into contracts with Standard Oil of California
and the Shell Oil Company for the purchase of gasoline for
Fiscal Year 1974 to insure a continued gasoline supply on
and after July 1, 1973, and
BE IT FURTHER RESOLVED that, pursuant to Section 421
of the City Charter, the City Manager be and hereby is
authorized to execute said contracts on behalf of the City
without advertising for and receiving competitive bids.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its regular adjourned meeting held on the
Z5th day of June , 1973.
