HomeMy WebLinkAbout73-109RESOLUTION NO. 73-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA RESCINDING RESOLUTION 73-96 AND UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND GRANTING VARIANCE APPLICATION NO. 73-32 FILED BY MAURINE T. SUTTON BE IT RESOLVED: That Resolution 73-96 formerly adopted by the City Council of the City of Santa Ana on August 20, 1973, is hereby rescinded; BE IT FURTHER RESOLVED: That based upon the Findings of Fact of the Planning Commission, and the evidence presented at a public hearing held August 6, 1973, the City Council of the City of Santa Ana does hereby grant Variance No. 73-32 filed by Maurine T. Sutton, 2211 E. First Street, Santa Aha, California, to remodel and use an existing motel as a half-way house for a maximum of 88 former mental patients and to provide 25 offstreet parking spaces, subject to the following conditions: 1. That development be according to the approved plot plan, except for minor modifications approved by the Planning Department; 2. That all conditions of the Building Department be met; 3. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Section 41-618 of the Zoning Ordinance (prior to issuance of a building permit) and that said landscaping be implemented (prior to utility release) and be continuously maintained; 4. That any trash areas be enclosed in accordance with the Planning Department standards; 5. That all conditions of the Fire Department be met; 6. Pay street lighting deposit for future street lights; 7. Pay street tree charges; 8. Construct necessary street improvements: a. Tree wells The following requirements must also be met: 1. That a block wall or opaque fencing 6' in height be maintained around the entire perimeter of the subject property except for the front driveway area & no interior fencing be permitted on the grounds for the subject property except for the swimming pool area; 2. That the stoves be removed and the gas pipes be capped in the kitchens of the 44 units which are to be used exclusively for residential purposes. Pipes are to be capped within the walls, and the walls replastered and painted; Resolution No. 73-109 Page 2 3. That all conditions and requirements of the State Department of Social Welfare, the State Department of Mental Hygiene, the Orange County Health Department, and all other public agencies be complied with. 4. That this facility be limited to a maximum number of 88 former mental patients or clients at any time; 5. All signs and sign structures and the two house trailers be completely removed from the premises; 6. That the applicant secure a valid license to operate a residential treatment center for the admission and treatment of adults with mental illness from the State Department of Social Welfare; 7. This variance shall terminate at the end of a 3 year period, to determine whether or not any problems have arisen due to this operation. The Planning Department shall thereafter report to the Planning Commission, which may grant an additional 3 year extension of this variance under the same conditions or under different conditions, without the necessity of filing an additional application. Any additional 3 year extensions of this variance, however, shall be subject to this same condition. Fire Department The buildings and its use shall conform to the regulations of Title 19, California Administrative Code {Public Safety) and the Uniform Fire Code. The buildings, housing ambulatory guests, shall be provided with an approved manual and automatic fire alarm system actuated by detectors responding to invisible products of combustion other than heat. 2A-IOBC rated dry chemical fire extinguishers shall be provided in conspicuous and accessible locations within 100 feet of travel distance from any area of each building. A water main system capable of delivering a total fire flow of 2,000 gallons per minute from an approved hydrant, located approximately 350 feet from the street curb, shall be provided. It shall be installed to conform to City Improvement Standard #403 and painted chrome yellow. This system shall be placed in service prior to the commencing of any combustible con- struction. Four copies of the hydrant system plan, including calculations, shall be submitted to us for approval. E. Plans of the above 5 conditions shall be submitted to the Fire Department for approval prior to issuance of a building permit.
