RESOLUTION NO. 73-110
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA ORDERING THE VACATION
OF ALLEY ON THE EAST SIDE OF HATHAWAY
RESERVING AN EASEMENT THEREIN FOR THE
CITY OF SAI~TA ANA
WHEREAS, on recommendation of the Department of Public Works
and the Planning Commission of the City of Santa Ana, The City
Council of the City of Santa Ana adopted Resolution No. 73-106,
giving notice of intention to vacate an alley on the east side
of Hathaway; and
WHEREAS, Resolution No. 73-106 was published, and notice
of intention to vacate was posted as required by law; and
WHEREAS, on October 1, 1973, a public hearing was duly
held on said vacation;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby finds that the above named alley
is no longer necessary for present or prospective street pur-
poses, and does hereby make its order to vacate said right
of way. Said right of way lies in the City of Santa Ana,
County of Orange, State of California, described as follows:
That certain alley in Tract No. 4450 in the City
of Santa Ana, County of Orange, State of California
as shown on a map recorded in Book 157, Pages 15
and 16 in the office of the County Recorder of said
County. The Westerly terminus of said alley being
the continuation of the right of way line of the
cul-de-sac having a 50.00 foot radius at the end of
Hathaway Street.
Excepting therefrom an easement for water mains over
that portion of said alley as shown on a deed to
the City of Santa Ana recorded in Book 10272, Pages
987 and 989 in the Office of the County Recorder of
said County.
BE IT FURTHER RESOLVED: That the public convenience
and necessity require the reservation of an easement over said
right of way for the City of Santa Ana for water main purposes.
BE IT FURTHER RESOLVED: That these proceedings are taken
subject to said easement over said right of way for the City
of Santa Ana for water main purposes.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its regular meeting held on the
day of October , 1973.
