A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AUTHORIZING THE EXECUTION OF AN
AMENDED JOINT POWERS AGREEMENT BETWEEN THE
CITY OF SANTA ANA AND THE EXISTING MEMBERS
OF THE SANTIAGO LIBRARY SYSTEM ADDING THE
ORANGE PUBLIC LIBRARY SYSTEM AS A MEMBER OF
THE SANTIAGO LIBRARY SYSTEM
WHEREAS, the City Council of the City of Santa Ana,
pursuant to Resolution 71-16, authorized the Mayor to
execute a Joint Powers Agreement between the City of Santa
Aha and the existing members of the Santiago Cooperative
Library System; and
WHEREAS, the Mayor of the City of Santa Ana, exe-
cuted a Joint Powers Agreement dated August 26, 1972,
making the City of Santa Ana a member of the Santiago
Library System, and approving the Rules and Procedures
and Plan of Service of the Santiago Library System; and
WHEREAS, Clause 9 of said Joint Powers Agreement
provides that other public libraries may apply for member-
ship in the Santiago Library System, provided they meet
the requirements for the system membership as established
by the California State Library and by the laws of the
State of California, and further provides that applicants
will be considered for the Santiago Library System member-
ship if their application is approved by the majority of
the system council and further provides that approved appli-
cations must be submitted to the governing board of each
library member, and further provides that membership will
be granted upon approval of the governing board of each
member library; and
WHEREAS, it is desired by the City of Orange to
join the Orange Public Library System, to the Santiago
Library System; and
WHEREAS, it is necessary to amend the aforesaid
Joint Powers Agreement dated August 26, 1972, in order to
add the Orange Public Library as a member of the Santiago
Library System, and to readopt and ratify the Rules and
Procedures and Plan of Service of the Santiago Library
System previously approved by the City Council.
NOW, THEREFORE, BE IT RESOLVED: That this Council, as
the governing body for the Santa Ana Public Library, adopts
and agrees to be bound by that certain amended Joint Powers
Agreement of the Santiago Library System dated November 5,
1973, a copy of which is attached hereto and made a part
hereof by reference as though set out in full herein;
BE IT FURTHER RESOLVED: That this Council as the gov-
erning body for the Santa Aha Public Library, readopts,
ratifies and agrees to be bound by the Rules and Procedures
and Plan of Service of the. Santiago Library System previously
approved by the Council on August 26, 1972, a copy of which
Rules and Procedures and Plan of Service of the Santiago
Library System are attached hereto and made a part
hereof by reference as though set out in full herein;
BE IT FURTHER RESOLVED: That the Mayor and the City
Clerk of the City of Santa Ana be and are hereby empowered
to execute the amended Joint Powers Agreement dated November
5, 1973, on behalf of the City of Santa Ana andthe Santa
Ana Public Library.

JOINT POWERS AGREEMENT
Pursuant to Title 1, Division 7, Chapter 5 of the Government
Code of the State of California (Sections 6500 to 6513), a Joint
Powers Agreement is hereby entered into between the ORANGE COUNTY
PUBLIC LIBRARY, the PLACENTIA LIBRARY DISTRICT, the YORBA LINDA
LIBRARY DISTRICT, the HUNTINGTON BEACH PUBLIC LIBRARY, the NEWPORT
BEACH PUBLIC LIBRARY, the FULLERTON PUBLIC LIBRARY, the SANTA ANA
PUBLIC LIBRARY, the ANAHEIM PUBLIC LIBRARY, and the ORANGE PUBLIC
LIBRARY.
RECITALS
WHEREAS, the State of California has enacted the Public Library
Services Act in order to encourage the development of free public
libraries throughout the State by grants to public library systems
for the purpose of:
(a)Assisting them in establishing, improving and
extending library services; and
(b) Encouraging the establishment of library systems
in areas where such cooperation would facilitate
improved service; and
WHEREAS, the parties to this Agreement are desirous of estab-
blishing a cooperative regional library system to be known as the
SANTIAGO LIBRARY SYSTEM for the purpose of improving and extending
library service to all residents of these Library Districts by
closer cooperation among their respective libraries, and in order
to obtain the benefits of such a system as provided by law on such
terms and conditions as hereinafter follow;
NOW, THEREFORE, pursuant to the provisions of the California
Education Code, Division 20, Chapter 1.5, comprising Sections 27111
to 27147, t~e Dsrties hereby form the SANTIAGO LIBRARY SYSTEM.
The obligations and conditions that hereinafter follow are

contingent upon approval by the State Librarian of the plan of
library service which has been submitted by the member libraries.
1. POWER OF SYSTEM. The SANTIAGO LIBRARY SYSTEM shall have
all the powers, prerogatives, and authority necessary to effective-
ly plan, operate and administer a public library system and to
establish, improve and extend library services within the geographic
boundaries of the SYSTEM. It shall plan and determine the use to
be made of any funds ~eceived by the SYSTEM from any source and may
expend such funds in accordance with such plans and determinations.
The System Council, or such administrative officer as it may from
time to time appoint, may administer and exercise this power pur-
suant to the rules and regulations as adopted in the manner set
out here-after.
2. GOVERNING BODY OF SYSTEM. The SANTIAGO LIBRARY SYSTEM
will be administered by a Council consisting of the Head Librarian
of each member library or such other person as has been designated
by the governing body of that library. Governing boards or Council
members may designate alternates to sit, deliberate and act in the
absence of the appointed Council member. The Council will elect one
of its members as President, who shall hold office for a one-year
term. Said term shall be for the operating year. The President,
or his designated alternate, shall preside over all meetings of
the Council. The Council shall draw up rules and regulations from
time to time as they deem advisable; however, such rules and regula-
tions shall not be valid until they have been ratified by the govern-
ing board of each member library. Proposed rules and regulations
will be adopted by a majority vote of the System Council as consti-
tuted at the time and submitted to the governing boards for ratifica-
tion. Every official action taken by the System Council shall be
affirmed by a formal vote of the members of the Council. Minutes
shall be kept of its meetings, copies of the minutes of each meet-
ing shall be transmitted to the governing board of each member library
within five days of the meeting. A journal shall be maintained re-
cording official acts taken.

3. SOURCE OF SYSTEM FUNDS. The SYSTEM shall expend for SYSTEM
purposes such monies as may be received from: (1) the State of
California pursuant to Article.6, Chapter 15, Division 20, Part 4
of the California Education Code or such other grants or appropria-
tions as may be made; (2) the Federal Government pursuant to any
program related to library purposes; (3) private or public founda-
tions, organizations, corporations, companies, unions, or associa-
tions; (4) private individuals by gift, devise or bequest. The
SYSTEM is empowered and authorized to make any applications and/or
agreements necessary to be or become eligible for such financial
support, except that such applications or agreements shall not impose
conditions of the type prohibited by Education Code Section 27121,
or the rules and regulations previously adopted by the SYSTEM pursuant
to Clause 2.
4. OWNERSHIP OF SYSTEM-PURCHASED ITEMS. Ownership of items
purchased with SYSTEM funds shall be in the SYSTEM or in member li-
braries as the System Council may in each instance determine. Such
determinations shall be made at the time of purchase.
5. OPERATING EXPENSES OF SYSTEM. The System Council may
authorize the payment of necessary SYSTEM salaries and expenses
from SYSTEM funds. The System Council may periodically authorize
the transfer of SYSTEM funds in such amounts as to them seem advisable,
to the ORANGE COUNTY PUBLIC LIBRARY to defray the estimated cost of
purchases of materials and supplies to be made for the benifit of
SYSTEM during the following period by the said ORANGE COUNTY PUBLIC
LIBRARY, acting in its role as fiscal agent of SYSTEM.
6. ACCOUNTING FOR FUNDS. All funds received and disbursed by
the SYSTEM shall be strictly accounted for, according to accepted
procedures and practices for governmental entities.
7. FISCAL AGENT. The ORANGE COUNTY PUBLIC LIBRARY will perform
the following services:
(a) Act as contracting agency with the State of
California for the receipt, disbursement and
accounting of such funds as may he allocated by
the State government, Federal government, or
private sources for SYSTEM use.
(b) Issue reports of receipts and disbursements and
accounting of funds, or shall do so on demand
of any member library.
(c) Act as the contracting officer for the SYSTEM
for the ordering and requisition of books, materials
and supplies required for the effective and efficient
operation of the SYSTEM.
8. ADMINISTRATION OF MEMBER LIBRARIES. The member libraries
shall administer their own public libraries independently, selecting
their own hooks, hiring their own personnel, and operating according
to the policies and rules established by their own governing bodies.
9. ADDITIONAL MEMBERS. Other public libraries may apply for
membership in the SANTIAGO LIBRARY SYSTEM, provided they meet the
requirements for SYSTEM membership as established by the California
State Library and by the laws of the State of California. Applicants
will be considered for SYSTEM membership if their application is
approved by a majority of the System Council. Approved applications
will be submitted to the governing board of each member library.
Membership will be granted upon approval of the governing board of
each member library.
10. WITHDRAWAL OF A MEMBER. Any member library may withdraw
from the SANTIAGO LIBRARY SYSTEM by serving formal written notice
of its intent to so withdraw at least one h~ndred and twenty (120)
days prior to the end of the operating year. The SYSTEM shall con-
tinue to exist so long as there are two member libraries, provided
that these two meet the requirements of SYSTEM membership. Libraries
which withdraw are subject to such rules and regulations governing
withdrawal as the System Council shall beforehand have established.

11. TERMINATION OF SYSTEM. ~his library system may be ter-
minated at any time by resolutions of the governing boards of all
the members in this SYSTEM at the time termination is voted. A
decision to terminate shall be come effective whenever designated
in the termination agreement. Upon termination, all just claims
against the SYSTEM shall be paid, distribution made to the State
and Federal governments as required by applicable law, and the
remaining assets distributed among all parties who are then members
of the SYSTEM in proportion to the population of each member in
relation to the total population in the SYSTEM.
12. FISCAL AND OPERATING YEAR. The fiscal year and the opera-
ting year of the SYSTEM shall be the same, and shall commence July
1st of each year.
13. DEBTS. That no debt, liability or obligation of the
SANTIAGO LIBRARY SYSTEM shall constitute any debt, liability or obli-
gation of any party to this Agreement.
14. AMENDMENT. This Agreement may only he amended by the
action of all the respective governing bodies constituting this
SYSTEM.
15. EFFECTIVE DATE. The effective date of this Agreement is
November 5j 1973

RULES AND 'PROCEDURES
MEETINGS
Meetings will be held at the Orange County Public Library unless
place of meeting is otherwise set by the System Council.
F~etings will be held at least once a month~ and a schedule of
bi-weekly m~etings on the 2nd and 4th Tuesday, of each month
will be followed until revised by a majority vote of the System
Council..
Any member may call for a special meeting by contacting the
President and stating the purpose.
The President will notify members of regular meetings at least
~hree (3) days prior to the meeting, ~nd .of special meetings at
least 24 hours in advance of the agenda proposed. If a member
cannot attend or send a representative, the President must be
notified at least one day prior t? the meeting. ·
~h[nutes of each meeting will be prepared by directive of the
President and sent to each member, governing board, and other
~esignees within ~ive (5) days after the meeting.
Xeutings will be held pursuant to the Ralph M. Brown Act as set
forth in the California Government Code.
II = QUORUM
A majority of the total voting members of the System Council will
Comprise the quorum.
No meetings will be held unless a quorum is present. -
III - VOTING .
The vote will be cast by the librarian or such other person as has
beun designated by the governing Board of the member libraries, or
by the representative accredited to the president by said librarian.
A simple majority of the quorum is required to enact any business
of the system unless otherwise stated in the Rules and Procedures.
A two-thirds majority vote of the membership is required for
adopting the budget and amending the Rules and Procedures.
The System Council will elect, one of its members President in
the first regular meeting of the operating (fiscal) year. The
president's term shall be one year, and he shall preside ~t all
Council meetings until his successor is elected in the first
meeting in July of the following year.
The President may also appoint committees who will study and
report to the System Council on specific programs.
V -AMENDmeNTS'
~mendments and additions to these rules may be proposed at any,
regular or special meeting. Such amendments will be published
in the minutes, voted on at the following meeting, and submitted
to the governing board of each agency for ratification, pursuant
to the Joint Powers Agreement.
VI - BUDGET A~D ACCOUNTIN~
The System Budget for the use of System funds is to be drawn up
and adopted by the System Council prior to requesting annual
grants from the State; to be reviewed and modified, if necessary,
after exact amount available is made known by th~ State.
The fiscal operating year shall be from July 1 through June 30.
The' Orange County Treasury will be designated the Depository for
· the System funds, and the County Treasurer as Treasurer for the
System·
The Orange County Auditor-Controller will be designated the
Auditor for the System and will establish a fund and maintain
a~propriate records for the System.
Internal accounting procedures will be adopted after consultation
with the designated auditor, and will be designed to insure com-
patibility with established accounting practices in use by him.
All bills will be approved by a majority vote of the System
Council and certified by the Council President and Fiscal Officer
before they are submitted to the County Auditor for payment.
As Fiscal Agent, the Orang~ County Publ%c Library will perform
the following services=

Issue quarterly reports of reqeipts and disburse-

VII - PERSONNEL
The System Council may contract for ~professional services, as
required.
The System Counci~ may from time to time employ personnel,
either permanent or in an extra help classification, to perform
obligations of the Plan of Service, as may be decided by the
System Council. Any personnel hired for these duties will be
processed through the Orange County Personnel Department and
'will be covered by an Orange County Personnel item number and
appropriate insurance and liability policies. All wages and
fringe benefits that will accrue under the OranGe County
Personqel Resolution will be paid for by the SyStem.

All purchases made by the Santiago Library System will be
transacted by and through the Orange County Purchasing
Department in accordance with their standard rules and
procedures.

PLAN OF SERVICE
A PLAN OF SERVICE, approved by the participating public agency or
agencies, must accompany the application of a library or libraries
for grants under the Public Library Services Act of 1963~ The
PLAN OF SERVICE must follow the outline below as to the sequence
~d numbpr~ng of topics and t_he. scope of each.

1. Selection of Materials
Describe the manner in which selection of materials will b~
consolidated or coordinated throughout the system. Attach
'copies of the system's written book selection policy.
It will be the policy of the system that elch member library will
continue to have sole responsibility for the materials which it
selects and purchases for its o%~n librar~ collection.
Staff members of the system mamber libraries .shall have access to
all review copies for examination as do ~he librarians of the
Orang~ County Library. At each meeting, consultation and
decision.as to the purchase, duplication and location of the
more expensive, scholarly and technical books, which are on the
monthly list for ordering, will be the primary objective, with
proper reporting to each Chief Librarian, as required.
Cooperative use of specialists in the initial selection committees
wil~ be a part of the continuing pattern of book selection. Each
participating library may have the use of a copy of the County
Library's monthly available list, which will include both new
a~d replacement titles to be selected for order.
A substantial portion of the grant for the System will be spent
cooperatively to strengthen the collections in areas where the
study has shown need exists.
Attached hereto is a copy of the System's wr~tt.n book selection
policy.

Describe the manner in which the acquisition of materials will
be consolidated or coordinated throughout the system.
The Orange County Library is presently utilizing the County's
oentralized data processing equipment (IBM 360) for producing
~nthly annotated "approved for order" lists (up to 1800 titles,
new and replacement), review of selections by title and branch,
print-out of vendor orders and enc=mbrances, and update of summary
financial reports throughout the year. Inclusion of ail members
of the Santiago Library System in these procedures will greatly
help in review of selections'and coordination of orders for wise
distribution of expensive and technical materials to be purchased
b~the System, as well as by the separate libraries.
Organization and Physical Preparation of Materials
~kscribe the manner in which the organization and physical
preparation of materials will be consolidated or coordinated
~roughout the system. If through a processing center,
indicate the agency responsible. If processing is to be
done by a public or private agency outside the system, indicate
the contractural arrangements contemplated for each library
/~a the system. Where two or more centers or outside agencies
are involved, indicate the manner in which the work is to be
~lvided. ?
Cooperative efforts will be made to consolidate t~e lists of hbldings
of system member libraries in order to produce a simplified means
of checking member libraries' collections. Member libraries may
oontract with the Orange County Library for inclusion in that
library's computer assisted book catalog. Ongoing efforts will
also include investigating the fea~ibilJ, ty of all compatible forms
Of cooperative organization and physical preparation of both book and
non-book library materials.

4. L~ndin~ of Materials
Describe the lendin~ policy which will obtain throughout the
system and any uniform regulation which may apply to the
· . entire system. Indicate whether a uniform borrowing card
will be provided all residents of the area served by tne
system. Include a definite statemenu that materials borrowed
from any one service outlet (main library, branch, station,
bookmobile) may be returned without penalty to any other
!~ervice outlet in the system.
L~brary materials will be freely available to all residents of the
area served by the System, subject always to the rules ~nd regula-
tions of the member libraries. ~y member library may borrow
materials from any other library of the System. A resident of the
area served may borrow materials from any member library or service

outlet and may return them without penalty (except for fines and
other penalties resulting from the misuse of materials) to any
other service outlet in the System.
With the availability of the book catalog, including hokdings and
locations for all member libraries, it will be possible to direct
E~quests promptly to the library listing that holding.
Uniform regulations will be discussed and agreed upon as the need
b~comes evident. No uniform borrower's card is planned at present
because of the d~fference in charging methods· Continuing studies
will be made as new systems become available at reasonable cost.
Special attention is being given now by the Orange County Library
to applications of E.D.P. systems that are being developed by IBM
a~d other compatiable systems, with the hope of finding a means of
centralized circulation control at reasonable cost. The sophis-
tication of the Orange County Data Processing Center's hardware
is such that investigation of feasible systems is warranted.
5o Reference and Research Servic~
Describe the reference and research service which will be avail-
ble throughout the system, including any central reference.

and method by which reference questions which cannot be
answered in any one service outlet will be referred to an
outlet with greater or more appropriate resources. -~'-
The system has two area libraries, Orange County Public LibrarY's
Garden Grove Branch and the Sana Ana Public Library· Both libraries'
reference facilities are open to all staff patrons of all member
libraries. Member libraries use area libraries for quick action
telephone reference questions· More lengthy research questions are
~=layed via teletype to the Reference.Center at the Santa Aha
Public Library. There research is done or the question is refer-
red to SCAN, INFO, the Sutro Library, The California State Library
or other agencies via TWX. The Reference Center is also the central
processing agency for all members' inter library loan requests.
Those requests unanswered by other members via teletype, are
relayed to the California State Library and other library systems
.~n~ libraries via TWX.
People are being encouraged to use their local l~braries by means of
-a public information program, financed by grants, making.them aware
of the enriched colleutions and cooperative service developed through
the System.

Describe the method whereby each participating library may
ascertain specific iholdings of all other participating
libraries. Include a definite statement that material and
information contained in any one service outlet will be
available on the same basis to all library users in the area
served by the system. Describe the method or methods by which

~aterials and information will be transferred from one
service outlet to another.

be available on the same basis to all library users in the area
served by the System. Inquiries between libraries will be
encouraged. ·
Information from non-circulating materials will be copied at cost
for all patrons. Users who cannot go to the library holding these
materials will be served by mail.
The System has established'a scheduled delivery service, based on
the County Library's delivery service, to deliver inter-library
~oans and material borrowed from one library and returned to
another. Costs of initiating the service are being defrayed from
grant funds, and continuing costs will be paid from said funds.
Equal Access
Include here a defihite statement that all of the services
of each library in the system will b~ available on the same
basis to all residents of the ~rea served by t. he system.
As stated in paragraphs 3 and 5 above, all of the services and
~aterials of each member library in the System are available to
all residents of the area served by the System, subject to the
rules and regulations of each member library - exceDt that non-
resident fees may not be charged by a member library to a resident
of another co~unity which is a member of the System.
B. E~tension Services
Attach a statement of each participating library's standards
· for branches, s.tations or other extension of service beyond
.its headquarters building.
It is the objective of all member libraries to meet all ALA
standards and many are currently developing standards for books,
deposit colleotions, delivery and bookmobile services.
9. Ma~or Libraries
List all public libraries containing 400,000 or more volumes
which may exist within the surrounding.area but are not
included in this system. Describe any agreements whereby the
resources of these libraries will ~e available to the system.
There is no library in this area other than Orange County ~ublic
Library which contains over 400,000 volumes.
~sources of major libraries in other areas are available primarily
through traditional inter-library loan procedures. It may be
possible in the future to work out reciprocal agreements with major
libraries in the Los Angeles-Long Beach area after thorough study
o£ the Lowell Martin report on the Regional Survey.
The developing college and university libraries in the Oranqe
County area, while not large at the present, offer an excellent
possibility of some sort of reciprocal use, if no more than that
o£ the usual inter-library loan, and inter-library cooperation
with many excellent industrial and technical libraries in the
County is already a fact, on an informal basis.
Area-Wide Pro~ects
Describe any services which may be planned for' the entire
a~ea or a larger portion of it than will be served by this
system and in which this system will participate. Such pro-
~ects may include a processing center, deposit center, major
~eference center, bibliographic center, etc.
Area-wide projects of cooperation are already established among
Orange County libraries, including public, college and university,
and industrial and technical. These.include':
Union list of periodicals..
Check-list of expensive reference and out-Of-print items.
Cooperative central storage (public libraries only.
Where is no actual contractural agreement, but the
governing boards approved cooperation under agreed
~lidelines of responsibility and selection).
Outreach - The Outreach Program will seek out and provide
& comprehensive resource of library materials.to that segment
of the population which has in the past indicated little use
for a library.
Physically Handicapped - Materials will include Optiscope
· enlargers for the visually handicapped; audio sets for the
hard of hearing; Masterlens systems for students with
visual problems; and Braille and talking books for the blind.
These materials will be made available in each member library
in an area easily accessible to those in wheel chairs, on
crutches, or to those vlsually handicapped. Materials
will be for use in the library, or arrangements will be
made for use in the home. This program is designed to
~troduce a service to a group who have not been previously
served; to bring to ~he handicapped an exciting new world;
to broaden the horizon of those who are not
pate in a world of sight, sound, and action.

Describe the manner in which any services provided by this
system will be coordinated with similar services provided
by other systems.
At the present time, none has been contemplated in Orange County.
Cooperation with other systems, such as the Metropolitan, Inland,

14. Legal...Structure.
Describe the legal structure within which the system will
operate. Include copies of pertinent contracts. Describe

The System has been established under the Public Library Services
Act of 1963 and as amended, 1966, Chapter 1.3 of Division 20 of
the ~ducation Code of the State of California.
A~reements between the members are authorized under the. Joint
~xercise of Power Act, Article 1, Chapter 5, Division 7,
Title 1, of the California Government Code.
With the consent of their respective governing bodies, all public
~ibrary agencies within Orange County are e!iqible for membership.
The Orange County Public Library is authorized by agreement to
'act as %he contracting agency for the System with the Sta:e of
California for the receipt, disbursement and accounting of such
f~ds as may be allocated by the State for System use.
A~ Executive Council, consisting of the head librarians of the
· ~nnber libraries or their designated representatives, acts as
the governing agency Qf the System, drawing up rules and regula-
tions for implementing the stated purposes of this system and its
opera%ion, and authorizing expenditures from system funds. The
council appoints a Chief Fiscal Officer. ~
