A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA REPEALING RESOLUTION NO. 73-140
AND APPROVING MAP AND DECLARING INTENTION TO
ABANDON ALLEY LOCATED NORTH OF FRUIT STREET
BETWEEN FRUIT STREET AND SANTA ANA BOULEVARD
APPROXIMATELY 125 FEET WEST OF LINCOLN AVENUE
WHEREAS, the Department of Public Works and the Planning
Commission have recommended a public hearing be set on the
question of said abandonment, a request for the abandonment of
an alley located north of Fruit Street between Fruit Street
and Santa Ana Boulevard approximately 125 feet west of Lincoln
Avenue has been received by the City Council.
WHEREAS, the City Council has previously adopted Resolution
No. 73-140 approving map and declaring intention to abandon
alley located north of Fruit Street between Fruit Street and
Santa Ana Boulevard approximately 125 feet west of Lincoln
Avenue; and
WHEREAS, the Department of Public Works has deemed it essen-
tial to the health, safety and welfare that vehicular access
rights across the northerly line of the above described property
be retained by theCity of Santa Ana.
NOW, THEREFORE, BE IT RESOLVED: That Resolution No. 73-140
is hereby repealed.
BE IT FURTHER RESOLVED: That the City Council hereby
approves the map attached hereto and orders the same filed with
the original of this Resolution in the Office of the Clerk of
the Council, and reference is hereby made to said map for the
exterior boundaries for said right of way proposed to be
abandoned.
The City Council declares its intention to proceed under
the provisions of the Street Vacation Act of 1941 (Section
8300 - 8374 of the California Streets and Highways Code) to
abandon that alley located north of Fruit Street between Fruit
Street and Santa Ana Boulevard approximately 125 feet west of
Lincoln Avenue, in the City of Santa Ana, County of Orange,
State of California, described as follows:
That portion of the alley in Block "E"
of Hawkins Addition, in the City of
Santa Ana, County of Orange, State of
California, as per map recorded in book
13 page 26 of Miscellaneous Records, in
the office of the County Recorder of Los
Angeles County, California, bounded
Northerly by a line parallel with and
distant 52.00 feet Southeasterly, mea-
sured at right angles, from a line
described as having a bearing and dis-
tance of South 64° 18" 01" West 1421.66
feet in a deed to the City of Santa Ana,
recorded December 17, 1968, in Book 8818
page 197 of Official Records and bounded
Southerly by the Westerly prolongation of
the Southerly line of Lot 17 of said
Block "E".

BE IT FURTHER RESOLVED: That the public convenience and
necessity require the reservation of an exclusive permanent
vehicular access rights across the northerly line of the
above described property by the City of Santa Ana.
BE IT FURTHER RESOLVED: That these proceedings are
taken subject to said vehicular access rights retained by the
City of Santa Ana.
BE IT FURTHER RESOLVED: That January 7, 1974, at the
hour of 7:30 p.m. in the Council Chambers, 22 Civic Center
Plaza, Santa Ana, California, is hereby fixed as the hour and
the place for hearing all persons interested in or objecting
to said proposed street vacation.
BE IT FURTHER RESOLVED: That the Clerk of the Council
of the City of Santa Ana is hereby ordered to publish this
Resolution one time in The Register, and the Director of Public
Works is ordered to post notices of street vacation conspi-
cuously along the line of said street, stating the passage of
this Resolution of Intention to Vacate and the time and place
of hearing thereon. Said notices shall be posted not more
than 300' apart and at least three (3) such notices shall be
posted. Both publication and posting shall be completed at
least ten (10) days before the date of the hearing.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its adjourned regular meeting held on the
10 day of December , 1973.
