HomeMy WebLinkAbout74-010RESOLUTION NO. 74-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SUPPORTING THE ENACTMENT OF FEDERAL LEGISLATION TO NULLIFY THE RECENT PARKING AND CARPOOL REGULATIONS OF THE ENVIRONMENTAL PROTEC- TION AGENCY AND POSTPONING FURTHER REGULATIONS UNTIL CONGRESS HAS STUDIED THEIR IMPACT AND ALTERNATIVES. W~EREAS, the City Council of the City of Santa Ana vigourously supports the objectives of the 1970 Clean Air Act and all efforts to implement such objectives towards cleaning up the environment; and WHEREAS, the federal Environmental Protection Agency (EPA) promulgated certain regulations on November 12, 1973, entitled the California Transportation Control Plan; and WHEREAS, the California Transportation Control Plan contains within its provisions regulations which would create and impose both economic and administrative chaos in and upon the public and private come, unities of the City of Santa Ana and elsewhere in the State of California; and WHEREAS, the City of Santa Ana, along with 180 other petitioners in the State of California, including 8 counties and 67 other cities, has filed with the federal Court of Appeals for the Ninth Circuit Petitions for Review, which petitions challenge both the constitutional as well as sta- tutory authority for said EPA regulations; and WHEREAS, EPA claims and purports to be acting pursuant to authority it claims to have been granted by the provisions of the federal "Clean Air Act" (42 USCA Sections 1856 et seq.); and WI~EREAS, Review could litigate and the legal issues raised by said Petitions for take several months and be extremely costly to finally resolve in the courts; and WHEREAS, as a matter of constitutional law, economic necessity and practical expediency, said legal issues can and should be resolved quickly by the immediate nullification of the parking surcharge, the management of parking supply and the preferential bus/carpool lanes provisions of EPA's Califor- nia Transportation Control Plan; and WHEREAS, the City of Santa Ana is seeking ways and means of improving the quality of its total environment, which ways and means will include consideration of the social and economic impact of its policies upon the residents, the businesses and the industries of the community. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby approves, endorses and urges the immediate enactment of federal legislation in the language and form as that contained in Section 202(c) of the former Senate Bill S2589 of the 1973 session of Congress at the earliest date practicable after Congress convenes in 1974.
