A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA UPHOLDING THE DECISION OF THE
PLANNING COMMISSION OF THE CITY OF SANTA ANA
AND APPROVING CONDITIONAL USE PERMIT 73-17
FILED BY THE EPM HUNT COMPANY
BE IT RESOLVED: That the City Council hereby receives
and files the Negative Declaration for CUP 73-17 and hereby
finds that even though the proposed project may have a signi-
ficant effect on the environment, the project is a lesser
and included part of Conditional Use Permit 73-10 for which
an Environmental Impact Report was approved by the City Council
for this project on June 25, 1973.
BE IT FURTHER RESOLVED: That based upon the Findings
of Fact of the Planning Commission of the City of Santa Ana, and
the Findings of Fact set forth herein, the City Council of the
City of Santa Ana does hereby grant CUP 73-17 filed by the EPM
Hunt Company, 4211 W. First Street, Santa Ana, California, to
amend CUP 73-10 to allow sales and display of models for mobile
homes within the mobile home park located at the aforesaid
address, subject to the following conditions:
1. That development be approved according to the
approved plot plan, except for minor modifications approved
by the Planning Department.
2. That all conditions of the Building Department be
met.
3. That a landscape plan be submitted to and approved
by the Planning Department, including the provisions of Section
41-618 of the Zoning Ordinance (prior to the issuance of a
building permit) and that said landscaping be implemented (prior
to utility release) and be continuously maintained.
4. That all conditions of the Fire Department be met.
5. Comply with all conditions of CUP 73-10.
6. Sales on site shall be for a period of time not to
exceed one year from the opening of the first models. An exten-
sion of time not to exceed an additional six (6) months may
be granted by the Planning Department. Sales on site shall not
continue after all mobile home sites are leased. In no case
shall more than one mobile home sale be permitted for each
leasable site. No sales for off-site locations shall be
permitted.
BE IT FURTHER RESOLVED: That the City Council hereby
makes the following findings of fact for CUP 73-17:
1. The proposed use under CUP 73-17 is necessary and
desirable to provide a service facility which will contribute

to the general well-being of the neighborhood and community.
2. The proposed use under CUP 73-17 will not, under the
circumstances of the particular case, be detrimental to the
health, safety, and general welfare of the persons residing
or working in the vicinity or injurious to property or
improvements in the vicinity.
3. The proposed use under CUP 73-17 will comply with
the regulations and conditions specified in Chapter 41 of
the Santa Ana Municipal Code for such a use.
4. The granting of this CUP 73-17 will not adversely
affect the General Plan of the City of Santa Ana.
5. The proposed mobile home park development is a
lesser included part of another project for which an Environ-
mental Impact Statement or Preliminary Environmental Description
having previously been submitted, and said project and state-
ment was approved by Council on June 25, 1973; and
6. The proposed use under CUP 73-10 and as
amended by CUP 73-17 is in the C2 and A1 zoning districts
as provided by City of Santa Ana's municipal zoning ordinances
and codes; and
7. The proposed use provides for the sale and display
ofmodels for mobile homes within a mobile home park develop-
ment to be known as LAKE PARK SANTA ANA at 4211 W. First
Street, in the City of Santa Ana; and
8. The proposed development will contain lots for
193 mobile homes on approximately 24 acres of land owned by
the developers, EPM HUNT COMPANY, together with recreation
facilities, parkways, common areas, storage and other features
unique to developments by developers; and
9. The proposed mobile park development is surrounded
on the north by vacant land and residential development, on
the east by a well drilling contractor's yard, on the south
by a mobile home park and vacant land, and on the west by
single family residential land and trailer storage; and
10. The proposed development is located on First
Street, which is a planned arterial highway; and
11. The proposed developers desire an all adult
mobile home community designed to provide aesthetic excellence
and to be environmentally acceptable and recognizable as an
outstanding mobile home community; and
12. To accomplish the goals stated in 11 above, the

developers desire to retain and maintain exclusive control
of their land and the proposed development by an "In Park
Sales Program"; and
13. The proposed use under CUP 73-17 contemplates
this "In Park Sales Program" and potential tenants of the
mobile home park will be given opportunity to select a new
mobile home from 8 to 10 mobile home manufacturers whose
mobile homes will be located in the development, and by such
program, customers will be able to see exactly how a parti-
cular home will look when constructed and placed in the park
in its normal environment and setting. Customers will also
be able to inquire into and see the types of porches, patios,
awnings, skirtings, concrete, fencing, and landscaping required
by the developer in the purchase and construction of the home;
and
14. The proposed mobile home park development has
many unique lot configurations requiring special consideration
for installation and set up and these considerations require
reversing floor plans, installation of special equipment,
construction of special wall figurations, precise placement of
homes, all within the exclusive knowledge of developers; and
15. The proposed use under CUP 73-17 providing
for an "In Park Sales Program" has been used by developers
successfully in a recent development located in Yorba Linda,
California. In addition to being thoroughly familiar with the
development of mobile home parks and sale of mobile homes,
developers have been licensed by the State of California as
Mobile Home Dealers (#TR484) and California Contractors
License C-61 (#287637) pertaining to installation of mobile
homes, bringing it entirely in compliance with SB 261 (1973)
enacted by the legislature of the State of California and
becoming effective January 1, 1974; and
16. The proposed mobile home park developers intend
not only to develop the park, but also continue to own and
operate the park indefinitely; and
17. The developers by being able to sell the mobile
home to the new tenant and aid the tenant in the installation
and set-up of his new home will also be able to provide a
continuing service to the tenant, even after the initial
development and sales program are completed; and
18. The proposed use under CUP 73-17 contemplates
only the sale of 193 mobile homes. After the initial sales
program is completed, developers will not maintain a sales
staff or program at this development, however, developers
and its staff will aid home owners in the resale of their
home and will guarantee the right of the homeowner to sell

his own home in place and no charge will be made to the
seller or to the buyer of the home unless developer renders
substantial and material services to seller (all being
within compliance of existing state laws); and
19. The proposed development and "In Park Sales
Program" provides the potential home purchaser with an
opportunity not unlike that afforded to the conventional home
buyer and the developer and builders of conventional homes
have repeatedly been given the right and opportunity to es-
tablish a sales office and sales staff to sell homes at the
site of the development.

of Santa Ana at its regular meeting held on the 21
