A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AUTHORIZING CONDEMNATION
OF REAL PROPERTY IN ORDER TO WIDEN NORTH
MAIN STREET
BE IT RESOLVED: That the City Council of the City of
Samta Aha does hereby find and declare that the public interest
and necessity require that in order to widen North Main Street,
the hereinbelow described real property be condemned.
BE IT FURTHER RESOLVED: That work is to begin immediately,
and it is necessary for the City of Santa Ana to have possession
of the hereinbelow described property as soon as possible.
BE IT FURTHER RESOLVED: That such acquisition is done in
a manner consistent with the greatest public good and the
least private injury.
BE IT FURTHER RESOLVED: That the attached map be entered
as Exhibit A and be used as an illustration of the hereinbelow
described property:
The Easterly 7.00 feet of the Westerly 19.00 feet
of Lot 4 in Block A of Tract No. 139 in the City
of Santa Ana, as per map recorded in Book 11, Page
36, Miscellaneous Maps, Records of Orange County
along with a spandrel shaped parcel of land bounded
Westerly by the East line of said Westerly 19.00
feet, bounded Southerly by the South line of said
Lot 4 and bounded Northeasterly by the arc of a
Curve concave Northeasterly having a radius of
25.00 feet being tangent to said Westerly and
Southerly boundaries.
Together with the right and easement to enter upon
the remaining portion of said lands of the owner for
the purpose of severing and removing the portions of
any building on said parcel which lies partly within
and partly without that portion of the above described
parcel of land which immediate possession is taken
and for the purposes of constructing and maintaining
any shoring, braces, foundations or walls necessary
to support the remaining improvements on said remaining
portion of said lands after severing and removing there-
from said portion of building at any time within 180
days after the date possession is authorized as indicated
in the order for possession, or within t80 days after
Final Judgment in condemnation, for the above enumerated
purposes.
BE IT FURTHER RESOLVED: That the City Attorney is hereby
ordered to bring an action in the name of the City of Santa
Ana to condemn said property necessary to be taken and to do
all things necessary to prosecute said action to final deter-
mination.
