HomeMy WebLinkAbout74-036RESOLUTION NO. 74-36~ - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING CONDEMNATION OF REAL PROPERTY IN ORDER TO WIDEN SEVENTEENTH STREET BE IT RESOLVED: Tha~,~the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require that in order to widen Seventeenth Street, the hereinbelow described real property be condemned. BE IT FURTHER RESOLVED: That work is to begin immediately, and it is necessary for the City of Santa Ana to have possession of the hereinbelow described property as soon as possible. BE IT FURTHER RESOLVED: That such acquisition is done a manner consistent with the greatest public good and the least private injury. in BE IT FURTHER RESOLVED: as Exhibit A and be used as described property: That the attached map be entered an illustration of the hereinbelow Ail those portions of Section 1, Township 5 South, Range 9 West, San Bernardino Base and Meridian described as follows: The Northerly 12.00 feet of the Southerly 52.00 feet of the Westerly 146.00 feet of the Easterly 191.00 feet of said Section 1, along with a spandrel shaped parcel of land that is bounded Easterly by a line parallel with and distant 45.00 feet Easterly, measured at right angles, from the East line of said Section 1, bounded Southerly by the North line of the Southerly 52.00 feet and bounded Northwesterly by the arc of a curve concave Northwesterly having a radius of 25.00 feet and being tangent to said Easterly and Southerly boundaries. Excepting therefrom those portions previously dedi- cated for street purposes. Together with the right and easement to enter upon the remaining portion of said lands of the owner for the purpose of severing and removing the portions of any building on said parcel which lies partly within and partly without the above described parcel of land and for the purposes of constructing and maintaining any shoring, braces, foundations or walls necessary to support the remaining improvements on said remaining portion of said lands after severing and removing there- from said portion of building at any time within ~80 days after the date possession is authorized as indicated in the order for possession, or within 180 days after Final Judgment in condemnation, for the above enumerated purposes. RESOLUTION NO. 74-36 PAGE TWO BE IT FURTHER RESOLVED: That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final deter- mination.
