A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA DEFERRING REQUIREMENT OF DEDICATION
AND IMPROVEMENT OF THE SOUTH ONE HALF OF JUNIPER
AVENUE BETWEEN HARBOR BLVD. AND THE SOUTHERN PA-
CIFIC RAILROAD RIGHT-OF-WAY.
WHEREAS, Pete Peterson of Plan of the Century, 9461
Gridlay St., Cypress, has applied on December 31, 1973, for
a building permit to perform alterations to an existing build-
ing located on Assessor's Parcel No. 140-031-23, said altera-
tions amounting to over $5,000 in value; and
WHEREAS,
provides for
suant to the
Section 33-47 of the Santa Ana Municipal Code
street dedications and improvements required pur-
issuance of a building permit; and
WHEREAS, the City Council of the City of Santa Ana on
March 18, 1974, at its reqular session heard a request of Mr.
F. A. Poss, Director of Operations of AMF-Voit, Inc., regard-
ing hardship to AMF-Voit in dedicating and improving the south
half of Juniper Avenue between Harbor Blvd. and the Southern
Pacific Railroad, abutting the north frontaqe of said parcel;
and
WHEREAS, the City Council of the City of Santa Ana feels
that it would be acceptable to defer the requirement of dedica-
tion and improvement of said south half of Juniper Avenue for
three years on condition that adequate assurances are provided
that the requirements of Section 33-47 concerning dedication
are met; and
WHEREAS, the City Council at its March 18, 1974, meeting
agreed to defer the requirement of dedication and improvement
of the south one half of Juniper Avenue between Harbor Blvd. and
the Southern Pacific Railroad right-of-way for three years
provided the AMF-Voit Corporation and the City, through its
staff, could agree to what the adequate assurances of dedica-
tion are; and
WHEREAS, the City Council in authorizing the release of
the building permit on the property in question did so upon con-
dition and in reliance upon the representations of the AMF-Voit
Company representatives that it would merely require time to go
through corporate channels to obtain approval of such an arrange-
ment; and
WHEREAS, the City Council has been informed that apparently
the AMF-Voit Company is still not in a position to negotiate such
an agreement providing the specified assurances.
NOW, THEREFORE, BE IT RESOLVED that the City staff is to
seek to enter into a contract with AMF-Voit providing such as-
surances of compliance by May 20, 1974.
BE IT FURTHER RESOLVED that should such efforts be unsuc-
cessful, the City Attorney's office is authorized to commence
appropriate legal proceedings to insure compliance with the re-
quirements of the Santa Ana Municipal Code Section 33-47, and
with the expressed desire of the Council to assure that the pro-
visions of Section 33-47 are met.

BE IT FURTHER RESOLVED that on May 20, 1974, the Director
of Building Safety is directed to revoke the previously issued
building permit based upon Section 302(e) of the Uniform Build-
ing Code.
