HomeMy WebLinkAbout74-055RESOLUTION NO. 74-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND GRANTING VARIANCE APPLICATION NO. 73-62 FILED BY THE FIRST WESTERN BANK AND TRUST COMPANY BE IT RESOLVED: That based upon the Findings of Fact of the Planning Commission, and based on the evidence presented at a public hearing held on April 1, 1974, the City Council of the City of Santa Ana does hereby grant Variance No. 73-62 filed by the First Western Bank and Trust Company, 1622 North Main Street, Santa Ana, California, to allow town house development in the R 2-PRD and R 1-PRD Districts with less than the required open space, subject to the following conditions: 1. That development be according to the approved plot plan, except for minor modifications approved by the Planning Depart- ment. 2. That all conditions of the Building Department be met. 3. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance (prior to issuance of a building permit) and that said landscaping be implemented (prior to utility re- lease) and be continuously maintained. 4. That any trash areas be enclosed in accordance with the Planning Department standards. 5. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways. 6. That a screening plan for mechanical equipment or appur- tenances be submitted to and approved by the Planning Department. 7. That all conditions of the Fire Department be met. 8. Submit to the Department of Public Works, for their approval, an acceptable final grading plan or an on-site drain- age plan, or both, showing the direction and means of flow to the adjacent street(s) or channel(s) when this property is developed. Plan is to include existing and proposed elevations at the proper- ty lines. Applicants should check with the Department of Public Works for extent of study needs. 9. Dedicate required street or alley right of way. 10. Dedicate vehicular access rights. 11. Provide construction plans for: a. required street improvement. 12. Pay drainage assessment fee. 13. Pay Sanitation District No. 7 fee. 14. Pay City water main charges. 15. Pay water service connection charges. 16. Pay street tree charges. 17. Comply with applicable conditions of previously approved tract map or parcel map pertaining to this site. RESOLUTION NO. 74-55 PAGE TWO 18. Construct necessary street improvements: a. paving b. curb and gutter c. sidewalk d. driveway e. tree wells 19. Construct necessary sewer facilities as required by the Department of Public Works. 20. Provide for installation of approved street lighting with underground service on all street frontages unless other- wise noted. 21. Ail plans and surveys for required public improvements shall be prepared under the direction of a registered Civil Engineer and shall be submitted to the Department of Public Works for approval. 22. Ail public improvement construction shall be subject to inspection and approval by the Department of Public Works. 23. Ail elevations shall be referenced to the 1958 Orange County Survey Datum. 24. Required property dedications shall be initiated by the owner, through the Department of Public Works, at least four weeks prior to application for a building permit, or use as applicable, to avoid delay. 25. The following requirements must also be met: A. Plans and elevations shall be submitted to the Planning Department for approval. B. Covenants conditions and restrictions be recorded prior to the issuance of building permits to guarantee permanent main- tenance of open space and all buildings. Said CC & R's shall meet the approval of the Planning Department and the City Attor- ney. The City shall be a party to said CC & R's. C. That automatic garage door openers be provided for all garages. D. That a minimum age limit of 14 years be incorporated in the CC & R's. Public Works A. The following requirement is also to be complied with prior to the issuance of a building permit: 1) Pay sewer assessment fee of $4.09 per front foot along Santa Clara Avenue. B. Details of Requirements - 1) Dedications - Santa Clara Avenue a) Street easement for a width of 40 feet from center- line to property line. b) Vehicular access rights except at approved drive. RESOLUTION NO. 74- 55 ~AGE THREE 2) Improvement Plans - Santa Clara Avenue 3) Improvements a) Santa Clara Avenue with pavement to meet existing pavement, curb and gutter 32 feet south of the centerllne and full-width sidewalk. b) Provide storm drain facilities as required by the Department of Public Works. NOTE: A run off study was previously submitted and accepted for this property. Fire Department A. Emergency access driveways and a fire hydrant system shall be provided to conform to the regulations of the Uniform Fire Code. B. 2A rated fire extinguishers shall be located on each story and within 100 feet of travel distance from any area of each building. C. Plans of the above two conditions shall be submitted to the Fire Department for approval. COMPLIANCE WITH CEQA PROCEDURES - NEGATIVE DECLARATION PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 15th day of April , 1974.
