A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA ORDERING THE VACATION OF A POR-
TION OF OLIVE STREET SOUTH OF McFADDEN AVENUE.
WHEREAS, on recommendation of the Department of Public
Works and the Planning Commission of the City of Santa Ana, Reso-
lution No. 74-71 was adopted giving notice of intention to vacate
a portion of Olive Street south of McFadden Avenue; and
WHEREAS, Resolution No. 74-71 was published and notice
of intention to vacate was posted as required by law; and
WHEREAS, on June 17, 1974, a public hearing was duly
held on said vacation;
WHEREAS, the Department of PUblic Works has deemed it
essential to the health, safety and welfare that an easement be
retained over said right of way for the City of Santa Ana for
utility purposes.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Santa Ana hereby finds that the above mentioned street
is unnecessary for present or prospective street purposes, and does
hereby make its order abandoning and vacating for street purposes
that certain right of way located in the City of Santa Ana, County
of Orange, State of California, described as follows:
That portion of Olive Street as shown on a
map of Tract No. 953 recorded in book 30,
page 23 of Miscellaneous Maps, records of
Orange County, California, described as fol-
lows:
Beginning 10.00 feet south of the Northeast
corner of Lot 2 on the easterly lot line of
said lot of said Tract No. 953 and running
thence North 890 42' East to the east line
of said Olive Street as shown on said map;
thence South 0° 24' West, along said East
line, 158.00 feet to its intersection with
the Easterly prolongation of the Southerly
line of Lot 1 of said Tract No. 953; thence
South 89o 42' West along said prolongation
to the Southeast corner of said Lot 1; thence
North 0° 26' 40" East 158.00 feet to the point
of beginning.
BE IT FURTHER RESOLVED that the public convenience and
necessity require the reservation of an exclusive permanent ease-
ment over said portion of Olive Street south of McFadden Avenue
by the City of Santa Ana for utility purposes.
BE IT FURTHER RESOLVED that these proceedings are taken
subject to said utility easements rights retained by the City of
Santa Ana.
